أَخْبَرَنَا الشَّافِعِيُّ رَضِيَ اللَّهُ عَنْهُ، قَالَ: أَخْبَرَنَا مُسْلِمُ بْنُ خَالِدٍ، عَنِ ابْنِ جُرَيْجٍ، عَنْ عَطَاءٍ، عَنِ ابْنِ عَبَّاسٍ وَابْنِ الزُّبَيْرِ: أَنَّهُمَا قَالا فِي الْمُخْتَلِعَةِ: يُطَلِّقُهَا زَوْجُهَا.قَالَ: لا يَلْزَمُهَا طَلاقٌ؛ لأَنَّهُ طَلَّقَ مَا لا يَمْلِكُ.

Tell us Shafei may Allah be pleased with him, said: Tell us Muslim bin Khalid, son of Greg, tender, Ibn Abbas and Ibn al-Zubayr: they said in Almokhtlah: divorce Zojha.qal she does not have a divorce; because he does not have what he divorced.
