أَخْبَرَنَا مَالِكٌ، عَنْ عَبْدِ اللَّهِ بْنِ الْفَضْلِ، عَنْ نَافِعِ بْنِ جُبَيْرٍ، عَنِ ابْنِ عَبَّاسٍ: أَنَّ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ: «الأَيِّمُ أَحَقُّ بِنَفْسِهَا مِنْ وَلِيِّهَا، وَالْبِكْرُ تُسْتَأْذَنُ فِي نَفْسِهَا، وَإِذْنُهَا صُمَاتُهَا» . أَخْرَجَ الأَوَّلَ مِنَ الْجُزْءِ الثَّانِي مِنَ اخْتِلافِ الْحَدِيثِ، وَالثَّانِيَ مِنْ كِتَابِ اخْتِلافِ مَالِكٍ وَالشَّافِعِيِّ.

Tell us the owner, Abdullah bin Fadl, Nafie bin Jabir, Ibn Abbas: The Prophet, peace be upon him said: «Aloim herself deserving of her guardian, and the eldest in herself asking her permission, and her permission Samadtha». Take the first out of the second part of the hadith differing, and the second from the different book of Malik and Al-Shafi’i.
