أَخْبَرَنَا الشَّافِعِيُّ رَضِيَ اللَّهُ عَنْهُ، قَالَ: أَخْبَرَنَا مُسْلِمُ بْنُ خَالِدٍ وَسَعِيدٌ، عَنِ ابْنِ جُرَيْجٍ، عَنْ عِكْرِمَةَ بْنِ خَالِدٍ: أَنَّ ابْنَ أُمِّ الْحَكَمِ سَأَلَ امْرَأَةً لَهُ أَنْ يُخْرِجَهَا مِنْ مِيرَاثِهَا مِنْهُ فِي مَرَضِهِ فَأَبَتْ فَقَالَ: لأُدْخِلَنَّ عَلَيْكِ فِيهِ مَنْ يُنْقِصُ حَقَّكِ أَوْ يَضُرُّ بِهِ فَنَكَحَ ثَلاثًا فِي مَرَضِهِ أَصْدَقَ كُلَّ وَاحِدَةٍ مِنْهُنَّ أَلْفَ دِينَارٍ، فَأَجَازَ ذَلِكَ عَبْدُ الْمَلِكِ بْنُ مَرْوَانَ. قَالَ سَعِيدُ بْنُ سَالِمٍ: إِنْ كَانَ صَدَاقَ مِثْلِهِنَّ جَازَ، وَإِنْ كَانَ أَكْثَرَ رُدَّتِ الزِّيَادَةُ وَقَالَ فِي الْمُحَابَاةِ كَمَا قُلْتُ أَنَا فِي كِتَابِ الْوَصَايَا الَّذِي لَمْ يَسْمَعْ مِنْهُ.
مسند امام شافی · Hadith 1120
Tell us Shafei may Allah be pleased with him, he said: Tell us Muslim bin Khalid Saeed, the son of Greg, Ikrima bin Khalid: that the son or the referee asked the woman to him that leads them out of her inheritance from him in his illness, and she refuses, he said: to were admitted to you where to diminish your right or hurt him Venkh Three in his disease, each one of them believed a thousand dinars, and he authorized that servant, King Bin Marwan. Saeed bin Salim said: If Sadaq is similar to them, it is permissible, and if it is more, the increase is rejected and he said in favor of what he said.
