أَخْبَرَنَا الشَّافِعِيُّ رَضِيَ اللَّهُ عَنْهُ، قَالَ: أَخْبَرَنَا مَالِكٌ، عَنْ عَبْدِ اللَّهِ بْنِ أَبِي بَكْرٍ، عَنْ عَبْدِ الْمَلِكِ بْنِ أَبِي بَكْرِ بْنِ عَبْدِ الرَّحْمَنِ بْنِ الْحَارِثِ بْنِ هِشَامٍ، عَنْ أَبِيهِ: أَنَّهُ أَخْبَرَهُ أَنَّ الْعَاصَ بْنَ هِشَامٍ هَلَكَ وَتَرَكَ بَنِينَ لَهُ ثَلاثَةً: ابْنَيْنِ لأُمٍّ، وَرَجُلا لِعِلَّةٍ فَهَلَكَ أَحَدُ اللَّذَيْنِ لأُمٍّ، وَتَرَكَ مَالا وَمَوَالِيَ، فَوَرِثَهُ أَخُوهُ الَّذِي لأُمِّهِ وَلأَبِيهِ مَالَهُ وَوَلاءَ مَوَالِيهِ ثُمَّ هَلَكَ الَّذِي وَرِثَ الْمَالَ وَوَلاءَ الْمَوَالِي وَتَرَكَ ابْنَهُ وَأَخَاهُ لأَبِيهِ، فَقَالَ ابْنُهُ: قَدْ أَحْرَزْتُ مَا كَانَ أَبِي أَحْرَزَ مِنَ الْمَالِ وَوَلاءَ الْمَوَالِي، وَقَالَ أَخُوهُ: لَيْسَ كَذَلِكَ إِنَّمَا أَحْرَزْتُ الْمَالَ فَأَمَّا وَلاءُ الْمَوَالِي فَلا، أَرَأَيْتَ لَوْ هَلَكَ أَخِي الْيَوْمَ أَلَسْتُ أَرِثُهُ أَنَا؟ فَاخْتَصَمَا إِلَى عُثْمَانَ رَضِيَ اللَّهُ عَنْهُ فَقَضَى لأَخِيهِ بِوَلاءِ الْمَوَالِي.أَخْرَجَهُ مِنْ كِتَابِ جِرَاحِ الْعَمْدِ.
مسند امام شافی · Hadith 1083
Tell us Shafei may Allah be pleased with him, he said: Tell us the owner, Abdullah bin Abi Bakr, Abd al-Malik ibn Abi Bakr bin Abdul Rahman bin Harith bin Hisham, from his father: that he told him that Aas bin Hisham perished and left Benin has three: two sons, mother, And a man for a cause, so that one of those who is a mother, and he left money and money, and his brother who inherited it for his mother and his father, his wealth and loyalty Mwale and left his son and his brother to his father, his son said, had made what was my father made money and loyalty pro, said his brother: not the case but made money either loyalty is not pro, what do you think if my brother died today I am not you his legacy? They disobeyed Othman, may God be pleased with him, and he spent his brother's loyalty on the authority of al-Mawali. He took it out of the book of the mayor's wounds.
