أَخْبَرَنَا الشَّافِعِيُّ رَضِيَ اللَّهُ عَنْهُ، قَالَ: أَخْبَرَنَا مَالِكٌ، عَنْ نَافِعٍ، عَنِ ابْنِ عُمَرَ رَضِيَ اللَّهُ عَنْهُمَا: أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ: «مَنْ أَعْتَقَ شِرْكًا لَهُ فِي عَبْدٍ، وَكَانَ لَهُ مَالٌ يَبْلُغُ ثَمَنَ الْعَبْدِ، قُوِّمَ عَلَيْهِ قِيمَةَ الْعَدْلِ، وَأُعْطِيَ شُرَكَاؤُهُ حِصَصَهُمْ وَعَتَقَ عَلَيْهِ الْعَبْدُ، وَإِلا فَقَدْ عَتَقَ مِنْهُ مَا عَتَقَ» .
مسند امام شافی · Hadith 1070
Tell us Shafei may Allah be pleased with him, said: Tell us Malik from Nafi from Ibn Umar that the Messenger of Allah, peace be upon him said: «of the freed shirk his slave, and had a capital of the price of the slave, the people of the value of justice, And his partners were given their shares and the servants freed him from him, or else he would be freed from them what he freed.
