أَخْبَرَنَا مَالِكٌ، عَنْ يَحْيَى بْنِ سَعِيدٍ، عَنْ سَعِيدِ بْنِ الْمُسَيِّبِ: أَنَّ رَجُلا بِالشَّامِ وَجَدَ مَعَ امْرَأَتِهِ رَجُلا فَقَتَلَهُ أَوْ قَتَلَهَا، فَكَتَبَ مُعَاوِيَةُ إِلَى أَبِي مُوسَى الأَشْعَرِيِّ أَنْ يَسْأَلَ لَهُ عَنْ ذَلِكَ عَلِيًّا رَضِيَ اللَّهُ عَنْهُ. فَسَأَلَهُ، فَقَالَ عَلِيٌّ: إِنَّ هَذَا لَشَيْءٌ مَا هُوَ بِأَرْضِ الْعِرَاقِ عَزَمْتُ عَلَيْكَ لَتُخْبِرَنِّي، فَأَخْبَرَهُ. فَقَالَ عَلِيٌّ رَضِيَ اللَّهُ عَنْهُ أَنَا أَبُو الْحَسَنِ: إِنْ لَمْ يَأْتِ بِأَرْبَعَةِ شُهَدَاءَ فَلْيُعْطَ بِرُمَّتِهِ. أَخْرَجَ الأَوَّلَ مِنْ كِتَابِ جِرَاحِ الْعَمْدِ، وَالثَّانِيَ مِنْ كِتَابِ أَدَبِ الْقَاضِي، وَالثَّالِثَ مِنْ كِتَابِ أَحْكَامِ الْقُرْآنِ، وَالرَّابِعَ مِنْ كِتَابِ الْجَنَائِزِ.

Tell us the owner, Yahya ibn Said from Said ibn al-Musayyib: that a man with his wife Baham found a man, killing him or kill her, wrote Sid to Abu Musa Ashari to ask him about that high may Allah be pleased with him. He asked him, and Ali said: This is something of the land of Iraq. I intend on you to tell me, so tell him. Ali, may God be pleased with him, said that I am Abu Al-Hassan: If he does not come with four martyrs, he will be given the sum. He removed the first from the book of the mayor's wounds, the second from the book of literature of the judge, and the third from the book of the rulings of the Qur’an, and the reward of the Qur’an.
