أَخْبَرَنَا الشَّافِعِيُّ رَضِيَ اللَّهُ عَنْهُ، قَالَ: أَخْبَرَنَا مُسْلِمُ بْنُ خَالِدٍ، عَنِ ابْنِ جُرَيْجٍ، عَنِ ابْنِ أَبِي مُلَيْكَةَ، عَنِ ابْنِ عَبَّاسٍ رَضِيَ اللَّهُ عَنْهُ: أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ: «الْبَيِّنَةُ عَلَى الْمُدَّعِي» . أَحْسِبُهُ قَالَ: وَلا أُثْبِتُهُ أَنَّهُ قَالَ: «وَالْيَمِينُ عَلَى الْمُدَّعى عَلَيْهِ» .
مسند امام شافی · Hadith 1693
Tell us Shafei may Allah be pleased with him, he said: Tell us Muslim bin Khalid, son of Greg, Ibn Abi Malika, Ibn Abbas, may Allah be pleased with him: that the Messenger of Allah, peace be upon him said: «the evidence to the prosecutor». I consider it he said: And I did not prove it that he said: “And the oath is against the defendant.”
