أَخْبَرَنَا الشَّافِعِيُّ رَضِيَ اللَّهُ عَنْهُ، قَالَ: أَخْبَرَنَا يَحْيَى بْنُ حَسَّانٍ، قَالَ: أَخْبَرَنَا اللَّيْثُ بْنُ سَعْدٍ، عَنِ ابْنِ شِهَابٍ، عَنِ ابْنِ الْمُسَيِّبِ، عَنْ أَبِي هُرَيْرَةَ رَضِيَ اللَّهُ عَنْهُ: أَنَّ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَضَى فِي جَنِينِ امْرَأَةٍ مِنْ بَنِي لِحْيَانَ سَقَطَ مَيِّتًا بِغُرَّةِ عَبْدٍ أَوْ أَمَةٍ ثُمَّ قَالَ: إِنَّ الْمَرْأَةَ الَّتِي قَضَى عَلَيْهَا بِالْغُرَّةِ تُوُفِّيَتْ فَقَضَى رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ بِأَنَّ مِيرَاثَهَا لابْنَيْهَا وَزَوْجِهَا، وَالْعَقْلَ عَلَى عَصَبَتِهَا.

Tell us Shafei may Allah be pleased with him, said: Tell us Yahya bin Hassan, he said: Tell us Laith bin Saad, Ibn Shihab from Ibn Musayyib, from Abu Hurayrah, may Allah be pleased with him: that the Prophet, peace be upon him spent in the Jenin woman from Bani Hayan fell dead By the wickedness of a servant or a nation, then he said: The woman who died on her by revelation is dead, so the Messenger of God, may God bless him and grant him peace, decreed that Behold, her husband, and her brains are on her mind.
