أَخْبَرَنَا الشَّافِعِيُّ رَضِيَ اللَّهُ عَنْهُ، قَالَ: أَخْبَرَنَا مُسْلِمٌ، عَنِ ابْنِ أَبِي حُسَيْنٍ، عَنْ عَطَاءٍ، وَطَاوُسٍ أَحْسَبُهُ قَالَ: وَمُجَاهِدٍ، وَالْحَسَنِ: أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ يَوْمَ الْفَتْحِ: «لا يُقْتَلُ مُؤْمِنٌ بِكَافِرٍ» .

مسند امام شافی · Hadith 1624

Tell us Shafei may Allah be pleased with him, said: Tell us a Muslim, Ibn Abi Hussein, tender, and Tawoos I think he said: Mujahid, and Hassan: that the Messenger of Allah, peace be upon him said on the opening: «Do not kill a believer Bccaffr».
