أَخْبَرَنَا الشَّافِعِيُّ رَضِيَ اللَّهُ عَنْهُ، قَالَ: أَخْبَرَنَا يَحْيَى بْنُ حَسَّانٍ، عَنِ اللَّيْثِ، عَنِ ابْنِ شِهَابٍ، عَنْ عَطَاءِ بْنِ يَزِيدَ اللَّيْثِيِّ، عَنْ عُبَيْدِ اللَّهِ بْنِ عَدِيِّ بْنِ الْخِيَارِ، عَنِ الْمِقْدَادِ، أَنَّهُ أَخْبَرَهُ أَنَّهُ قَالَ: يَا رَسُولَ اللَّهِ، أَرَأَيْتَ إِنْ لَقِيتُ رَجُلا مِنَ الْكُفَّارِ فَقَاتَلَنِي فَضَرَبَ إِحْدَى يَدَيَّ بِالسَّيْفِ فَقَطَعَهَا ثُمَّ لاذَ مِنِّي بِشَجَرَةٍ، فَقَالَ: أَسْلَمْتُ للَّهِ، أَفَأَقْتُلُهُ يَا رَسُولَ اللَّهِ بَعْدَ أَنْ قَالَهَا؟ قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: «لا تَقْتُلْهُ» ، فَقُلْتُ: يَا رَسُولَ اللَّهِ، إِنَّهُ قَطَعَ يَدِي، ثُمَّ قَالَ ذَلِكَ بَعْدَ أَنْ قَطَعَهَا، أَفَأَقْتُلُهُ؟ فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: «لا تَقْتُلْهُ؛ فَإِنَّهُ بِمَنْزِلَتِكَ قَبْلَ أَنْ تَقْتُلَهُ، وَإِنَّكَ بِمَنْزِلَتِهِ قَبْلَ أَنْ يَقُولَ كَلِمَتَهُ الَّتِي قَالَ» .

Tell us Shafei may Allah be pleased with him, said: Tell us Yahya bin Hassan, for Laith, Ibn Shihab from Ata ibn Yazid Laithi, Obaidullah bin Adi bin option, for Mekdad, he told him that he said: O Messenger of Allaah, what received a man From the disbelievers, he fought me, and he struck one of my hands with the sword, so he cut them and then took refuge from me with a tree. He said: I have peace with God. The Messenger of God, may God’s prayers and peace be upon him, said: “Do not kill him.” Then I said: O Messenger of God, he cut off my hand, then he said. Then the Messenger of God, may God’s prayers and peace be upon him, said: “Do not kill him, for he is in your house before you kill him, and if you do, then say.”
