أَخْبَرَنَا الشَّافِعِيُّ رَضِيَ اللَّهُ عَنْهُ، قَالَ: أَخْبَرَنَا مَالِكٌ، عَنِ ابْنِ شِهَابٍ، عَنِ السَّائِبِ بْنِ يَزِيدَ: أَنَّ عُبَيْدَ اللَّهِ بْنَ عَمْرٍو الْحَضْرَمِيَّ جَاءَ بِغُلامٍ لَهُ إِلَى عُمَرَ بْنِ الْخَطَّابِ رَضِيَ اللَّهُ عَنْهُ، فَقَالَ لَهُ: اقْطَعْ يَدَ هَذَا؛ فَإِنَّهُ سَرَقَ، فَقَالَ عُمَرُ بْنُ الْخَطَّابِ رَضِيَ اللَّهُ عَنْهُ: فِي مَاذَا سَرَقَ؟ قَالَ: سَرَقَ مِرْآةً لامْرَأَتِي ثَمَنُهَا سِتُّونَ دِرْهَمًا. فَقَالَ لَهُ عُمَرُ رَضِيَ اللَّهُ عَنْهُ: أَرْسِلْهُ لَيْسَ عَلَيْهِ قَطْعٌ، خَادِمُكُمْ سَرَقَ مَتَاعَكُمْ. أَخْرَجَهُ فِي كِتَابِ اخْتِلافِ مَالِكٍ وَالشَّافِعِيِّ.
مسند امام شافی · Hadith 1594
Tell us Shafei may Allah be pleased with him, said: Tell us Malik from Ibn Shihab from Saa'ib ibn Yazid: that Obeid-Allah ibn Amr Hadrami came Bghulam him to Omar ibn al-Khattab may Allah be pleased with him, he said to him: I will cut off the hands of this; it was stolen, said Omar bin The speech, may God be pleased with him: What was stolen? He said: He stole a woman for sixty dirhams. Omar, may God be pleased with him, said to him: Send him without cutting, your servant has stolen your belongings. Bring it in the book of the difference of Malik and Al-Shafi’i.
