أَخْبَرَنَا الشَّافِعِيُّ رَضِيَ اللَّهُ عَنْهُ، قَالَ: أَخْبَرَنَا مُحَمَّدُ بْنُ إِسْمَاعِيلَ بْنِ أَبِي فُدَيْكٍ، عَنِ ابْنِ أَبِي ذِئْبٍ، عَنِ ابْنِ شِهَابٍ، عَنْ سَعِيدِ بْنِ الْمُسَيِّبِ رَضِيَ اللَّهُ عَنْهُ: أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ: «لا يَغْلَقُ الرَّهْنُ الرَّهْنَ مِنْ صَاحِبِهِ الَّذِي رَهَنَهُ، لَهُ غُنْمُهُ وَعَلَيْهِ غُرْمُهُ» . قَالَ الشَّافِعِيُّ: غُنْمُهُ: زِيَادَتُهُ، وَغُرْمُهُ: هَلاكُهُ وَنَقْصُهُ.
مسند امام شافی · Hadith 1477
Tell us Shafei may Allah be pleased with him, said: Tell us Mohammed bin Ismail bin Abi Vedic, Ibn Abi wolf, Ibn Shihab from Said ibn al-Musayyib, may Allah be pleased with him: that the Messenger of Allah, peace be upon him said: «not mortgage closes the mortgage from the owner, who His bond, he has his sheep, and he has his fine. Al-Shafi’i said: His sheep: his increase, and his fine: his loss and shortage.
