أَخْبَرَنَا الشَّافِعِيُّ رَضِيَ اللَّهُ عَنْهُ، قَالَ: أَخْبَرَنَا مَالِكٌ، عَنْ يَحْيَى بْنِ سَعِيدٍ، عَنِ الْقَاسِمِ، قَالَ: سَمِعْتُ عَبْدَ اللَّهِ بْنَ عَبَّاسٍ رَضِيَ اللَّهُ عَنْهُ وَرَجُلٌ يَسْأَلُهُ عَنْ رَجُلٍ سَلَّفَ فِي سَبَائِكَ، قَالَ الرَّبِيعُ: سَبَائِكَ، فَأَرَادَ أَنْ يَبِيعَهَا قَبْلَ أَنْ يَقْبِضَهَا. قَالَ ابْنُ عَبَّاسٍ: تِلْكَ الْوَرِقُ بِالْوَرِقِ، وَكَرِهَ ذَلِكَ. وَقَالَ مَالِكٌ: وَذَلِكَ فِيمَا نَرَى لأَنَّهُ أَرَادَ أَنْ يَبِيعَهَا مِنْ صَاحِبِهِ الَّذِي اشْتَرَاهُ بِأَكْثَرَ مِنَ الثَّمَنِ الَّذِي ابْتَاعَهَا مِنْهُ، وَلَوْ بَاعَهَا مِنْ غَيْرِ الَّذِي اشْتَرَاهَا مِنْهُ لَمْ يَكُنْ بِبَيْعِهِ بَأْسٌ.
مسند امام شافی · Hadith 1444
Tell us Shafei may Allah be pleased with him, said: Tell us the owner, Yahya bin Said, Qasim, said: I heard Abdullah bin Abbas, may Allah be pleased with him and a man asking him about a man's predecessor in the alloy, spring: alloy, so he wanted to sell it before taking possession, he said. Ibn Abbas said: That paper is paper, and it is hated. Malik said: so as we see it because he wanted to sell it from the owner, who bought more than the price purchased by him, even if it is sold, who bought it did not sell quite a bit.
