حَدَّثَنَا ابْنُ السَّرْحِ قَالَ وَجَدْتُ فِي کِتَابِ خَالِي عَبْدِ الرَّحْمَنِ بْنِ عَبْدِ الْحَمِيدِ عَنْ عُقَيْلٍ عَنْ ابْنِ شِهَابٍ أَخْبَرَهُ أَنَّ عَبْدَ اللَّهِ بْنَ عَبْدِ الرَّحْمَنِ بْنِ الْأَزْهَرِ أَخْبَرَهُ عَنْ أَبِيهِ قَالَ أُتِيَ النَّبِيُّ صَلَّی اللَّهُ عَلَيْهِ وَسَلَّمَ بِشَارِبٍ وَهُوَ بِحُنَيْنٍ فَحَثَی فِي وَجْهِهِ التُّرَابَ ثُمَّ أَمَرَ أَصْحَابَهُ فَضَرَبُوهُ بِنِعَالِهِمْ وَمَا کَانَ فِي أَيْدِيهِمْ حَتَّی قَالَ لَهُمْ ارْفَعُوا فَرَفَعُوا فَتُوُفِّيَ رَسُولُ اللَّهِ صَلَّی اللَّهُ عَلَيْهِ وَسَلَّمَ ثُمَّ جَلَدَ أَبُو بَکْرٍ فِي الْخَمْرِ أَرْبَعِينَ ثُمَّ جَلَدَ عُمَرُ أَرْبَعِينَ صَدْرًا مِنْ إِمَارَتِهِ ثُمَّ جَلَدَ ثَمَانِينَ فِي آخِرِ خِلَافَتِهِ ثُمَّ جَلَدَ عُثْمَانُ الْحَدَّيْنِ کِلَيْهِمَا ثَمَانِينَ وَأَرْبَعِينَ ثُمَّ أَثْبَتَ مُعَاوِيَةُ الْحَدَّ ثَمَانِينَ

Narrated Abdur Rahman ibn al-Azhar: A man who had drunk wine was brought before the Prophet ﷺ when he was in Hunayn. He threw some dust on his face. He then ordered his Companions and they beat him with their sandals and whatever they had in their hands. He then said to them: Leave him, and they left him. The Messenger of Allah ﷺ then died, and Abu Bakr gave forty lashes for drinking wine, and then Umar in the beginning of his Caliphate inflicted forty stripes and at the end of his Caliphate he inflicted eighty stripes. Uthman (after him) inflicted both punishments, eighty and forty stripes, and finally Muawiyah established eighty stripes.

حَدَّثَنَا الْحَسَنُ بْنُ عَلِيٍّ حَدَّثَنَا عُثْمَانُ بْنُ عُمَرَ حَدَّثَنَا أُسَامَةُ بْنُ زَيْدٍ عَنْ الزُّهْرِيِّ عَنْ عَبْدِ الرَّحْمَنِ بْنِ أَزْهَرَ قَالَ رَأَيْتُ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ غَدَاةَ الْفَتْحِ وَأَنَا غُلَامٌ شَابٌّ يَتَخَلَّلُ النَّاسَ يَسْأَلُ عَنْ مَنْزِلِ خَالِدِ بْنِ الْوَلِيدِ فَأُتِيَ بِشَارِبٍ فَأَمَرَهُمْ فَضَرَبُوهُ بِمَا فِي أَيْدِيهِمْ فَمِنْهُمْ مَنْ ضَرَبَهُ بِالسَّوْطِ وَمِنْهُمْ مَنْ ضَرَبَهُ بِعَصًا وَمِنْهُمْ مَنْ ضَرَبَهُ بِنَعْلِهِ وَحَثَى رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ التُّرَابَ فَلَمَّا كَانَ أَبُو بَكْرٍ أُتِيَ بِشَارِبٍ فَسَأَلَهُمْ عَنْ ضَرْبِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ الَّذِي ضَرَبَهُ فَحَزَرُوهُ أَرْبَعِينَ فَضَرَبَ أَبُو بَكْرٍ أَرْبَعِينَ فَلَمَّا كَانَ عُمَرُ كَتَبَ إِلَيْهِ خَالِدُ بْنُ الْوَلِيدِ إِنَّ النَّاسَ قَدْ انْهَمَكُوا فِي الشُّرْبِ وَتَحَاقَرُوا الْحَدَّ وَالْعُقُوبَةَ قَالَ هُمْ عِنْدَكَ فَسَلْهُمْ وَعِنْدَهُ الْمُهَاجِرُونَ الْأَوَّلُونَ فَسَأَلَهُمْ فَأَجْمَعُوا عَلَى أَنْ يَضْرِبَ ثَمَانِينَ قَالَ و قَالَ عَلِيٌّ إِنَّ الرَّجُلَ إِذَا شَرِبَ افْتَرَى فَأَرَى أَنْ يَجْعَلَهُ كَحَدِّ الْفِرْيَةِ قَالَ أَبُو دَاوُد أَدْخَلَ عُقَيْلُ بْنُ خَالِدٍ بَيْنَ الزُّهْرِيِّ وَبَيْنَ ابْنِ الْأَزْهَرِ فِي هَذَا الْحَدِيثِ عَبْدَ اللَّهِ بْنَ عَبْدِ الرَّحْمَنِ بْنِ الْأَزْهَرِ عَنْ أَبِيهِ

Narrated Abdur Rahman ibn Azhar: I saw the Messenger of Allah ﷺ on the morning of the conquest of Makkah when I was a young boy. He was walking among the people, seeking the camp of Khalid ibn al-Walid. A man who had drunk wine was brought (before him) and he ordered them (to beat him). So they beat him with what they had in their hands. Some struck him with whips, some with sticks and some with sandals. The Messenger of Allah ﷺ threw some dust on his face. When a man who had drunk wine was brought before Abu Bakr, he asked them (i. e. the people) about the number of beatings which they gave him. They numbered it forty. So Abu Bakr gave him forty lashes. When Umar came to power, Khalid ibn al-Walid wrote to him: The people have become addicted to drinking wine and they look down upon the prescribed punishment and its penalty. He said: They are with you, ask them. The immigrants who embraced Islam in the beginning were with him. He asked them and they agreed on the fact that (a drunkard) should be given eighty lashes. Ali said: When a man drinks wine, he tells lies. I, therefore, think that he should be prescribed punishment that is prescribed for telling lies. . Abu Dawud said: 'Uqail bin Khalid included in the chain of this tradition: "Abdullah bin Abdur-Rahman bin al-Azhar from his father" between al-Zuhri and Ibn al-Azhar.

حَدَّثَنَا هِشَامُ بْنُ عَمَّارٍ حَدَّثَنَا صَدَقَةُ يَعْنِي ابْنَ خَالِدٍ حَدَّثَنَا الشُّعَيْثِيُّ عَنْ زُفَرَ بْنِ وَثِيمَةَ عَنْ حَکِيمِ بْنِ حِزَامٍ أَنَّهُ قَالَ نَهَی رَسُولُ اللَّهِ صَلَّی اللَّهُ عَلَيْهِ وَسَلَّمَ أَنْ يُسْتَقَادَ فِي الْمَسْجِدِ وَأَنْ تُنْشَدَ فِيهِ الْأَشْعَارُ وَأَنْ تُقَامَ فِيهِ الْحُدُودُ

Narrated Hakim ibn Hizam: The Messenger of Allah ﷺ forbade to take retaliation in the mosque, to recite verses in it and to inflict the prescribed punishments in it.

حَدَّثَنَا أَبُو کَامِلٍ حَدَّثَنَا أَبُو عَوَانَةَ عَنْ عُمَرَ يَعْنِي ابْنَ أَبِي سَلَمَةَ عَنْ أَبِيهِ عَنْ أَبِي هُرَيْرَةَ عَنْ النَّبِيِّ صَلَّی اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ إِذَا ضَرَبَ أَحَدُکُمْ فَلْيَتَّقِ الْوَجْهَ

Abu Burdah reported the Messenger of Allah ﷺ as saying: No more than ten lashes are to be given, except in the case of one of the punishment prescribed by Allah, the Exalted.

أَخْبَرَنَا قُتَيْبَةُ بْنُ سَعِيدٍ حَدَّثَنَا اللَّيْثُ عَنْ يَزِيدَ بْنِ أَبِي حَبِيبٍ عَنْ بُکَيْرِ بْنِ عَبْدِ اللَّهِ بْنِ الْأَشَجِّ عَنْ سُلَيْمَانَ بْنِ يَسَارٍ عَنْ عَبْدِ الرَّحْمَنِ بْنِ جَابِرِ بْنِ عَبْدِ اللَّهِ عَنْ أَبِي بُرْدَةَ أَنَّ رَسُولَ اللَّهِ صَلَّی اللَّهُ عَلَيْهِ وَسَلَّمَ کَانَ يَقُولُ لَا يُجْلَدُ فَوْقَ عَشْرِ جَلَدَاتٍ إِلَّا فِي حَدٍّ مِنْ حُدُودِ اللَّهِ عَزَّ وَجَلَّ

The tradition mentioned above has also been transmitted by Abu Burdah al-Ansari through a different chain of narrators. This version has: I heard the Messenger of Allah ﷺ say. . . He then mentioned the tradition to the same effect.

Narrated Abu Hurairah: The Prophet ﷺ said: When one of you inflicts a beating, he should avoid striking the face.

حَدَّثَنَا مُحَمَّدُ بْنُ الْعَلَاءِ حَدَّثَنَا عُبَيْدُ اللَّهِ يَعْنِي ابْنَ مُوسَی عَنْ عَلِيِّ بْنِ صَالِحٍ عَنْ سِمَاکِ بْنِ حَرْبٍ عَنْ عِکْرِمَةَ عَنْ ابْنِ عَبَّاسٍ قَالَ کَانَ قُرَيْظَةُ وَالنَّضِيرُ وَکَانَ النَّضِيرُ أَشْرَفَ مِنْ قُرَيْظَةَ فَکَانَ إِذَا قَتَلَ رَجُلٌ مِنْ قُرَيْظَةَ رَجُلًا مِنْ النَّضِيرِ قُتِلَ بِهِ وَإِذَا قَتَلَ رَجُلٌ مِنْ النَّضِيرِ رَجُلًا مِنْ قُرَيْظَةَ فُودِيَ بِمِائَةِ وَسْقٍ مِنْ تَمْرٍ فَلَمَّا بُعِثَ النَّبِيُّ صَلَّی اللَّهُ عَلَيْهِ وَسَلَّمَ قَتَلَ رَجُلٌ مِنْ النَّضِيرِ رَجُلًا مِنْ قُرَيْظَةَ فَقَالُوا ادْفَعُوهُ إِلَيْنَا نَقْتُلُهُ فَقَالُوا بَيْنَنَا وَبَيْنَکُمْ النَّبِيُّ صَلَّی اللَّهُ عَلَيْهِ وَسَلَّمَ فَأَتَوْهُ فَنَزَلَتْ وَإِنْ حَکَمْتَ فَاحْکُمْ بَيْنَهُمْ بِالْقِسْطِ وَالْقِسْطُ النَّفْسُ بِالنَّفْسِ ثُمَّ نَزَلَتْ أَفَحُکْمَ الْجَاهِلِيَّةِ يَبْغُونَ قَالَ أَبُو دَاوُد قُرَيْظَةُ وَالنَّضِيرُ جَمِيعًا مِنْ وَلَدِ هَارُونَ النَّبِيِّ عَلَيْهِ السَّلَام

Narrated Abdullah Ibn Abbas: Qurayzah and Nadir (were two Jewish tribes). An-Nadir were nobler than Qurayzah. When a man of Qurayzah killed a man of an-Nadir, he would be killed. But if a man of an-Nadir killed a man of Qurayzah, a hundred wasq of dates would be paid as blood-money. When Prophethood was bestowed upon the Prophet ﷺ, a man of an-Nadir killed a man of Qurayzah. They said: Give him to us, we shall kill him. They replied: We have the Prophet ﷺ between you and us. So they came to him. Thereupon the following verse was revealed: "If thou judge, judge in equity between them. " "In equity" means life for a life. The following verse was then revealed: "Do they seek of a judgment of (the days) ignorance?" Abu Dawud said: Quraizah and al-Nadir were the descendants of Harun the Prophet ﷺ

حَدَّثَنَا أَحْمَدُ بْنُ يُونُسَ حَدَّثَنَا عُبَيْدُ اللَّهِ يَعْنِي ابْنَ إِيَادٍ حَدَّثَنَا إِيَادٌ عَنْ أَبِي رِمْثَةَ قَالَ انْطَلَقْتُ مَعَ أَبِي نَحْوَ النَّبِيِّ صَلَّی اللَّهُ عَلَيْهِ وَسَلَّمَ ثُمَّ إِنَّ رَسُولَ اللَّهِ صَلَّی اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ لِأَبِي ابْنُکَ هَذَا قَالَ إِي وَرَبِّ الْکَعْبَةِ قَالَ حَقًّا قَالَ أَشْهَدُ بِهِ قَالَ فَتَبَسَّمَ رَسُولُ اللَّهِ صَلَّی اللَّهُ عَلَيْهِ وَسَلَّمَ ضَاحِکًا مِنْ ثَبْتِ شَبَهِي فِي أَبِي وَمِنْ حَلِفِ أَبِي عَلَيَّ ثُمَّ قَالَ أَمَا إِنَّهُ لَا يَجْنِي عَلَيْکَ وَلَا تَجْنِي عَلَيْهِ وَقَرَأَ رَسُولُ اللَّهِ صَلَّی اللَّهُ عَلَيْهِ وَسَلَّمَ وَلَا تَزِرُ وَازِرَةٌ وِزْرَ أُخْرَی

Narrated Abu Rimthah: I went to the Prophet ﷺ with my father. The Messenger of Allah ﷺ then asked my father: Is this your son? He replied: Yes, by the Lord of the Kabah. He again said: Is it true? He said: I bear witness to it. The Messenger of Allah ﷺ then smiled for my resemblance with my father, and for the fact that my father took an oath upon me. He then said: He will not bring evil on you, nor will you bring evil on him. The Messenger of Allah ﷺ recited the verse: "No bearer of burdens can bear the burden of another. "

حَدَّثَنَا عَبْدُ اللَّهِ بْنُ مَسْلَمَةَ بْنِ قَعْنَبٍ الْقَعْنَبِيُّ حَدَّثَنَا عَبْدُ الْعَزِيزِ يَعْنِي ابْنَ مُحَمَّدٍ عَنْ مُحَمَّدٍ يَعْنِي ابْنَ عَمْرٍو عَنْ أَبِي سَلَمَةَ عَنْ الْمُغِيرَةِ بْنِ شُعْبَةَ أَنَّ النَّبِيَّ صَلَّی اللَّهُ عَلَيْهِ وَسَلَّمَ کَانَ إِذَا ذَهَبَ الْمَذْهَبَ أَبْعَدَ

Narrated Mughirah ibn Shubah: When the Prophet ﷺ went (outside) to relieve himself, he went to a far-off place.

حَدَّثَنَا مُسَدَّدُ بْنُ مُسَرْهَدٍ حَدَّثَنَا عِيسَی بْنُ يُونُسَ أَخْبَرَنَا إِسْمَعِيلُ بْنُ عَبْدِ الْمَلِکِ عَنْ أَبِي الزُّبَيْرِ عَنْ جَابِرِ بْنِ عَبْدِ اللَّهِ أَنَّ النَّبِيَّ صَلَّی اللَّهُ عَلَيْهِ وَسَلَّمَ کَانَ إِذَا أَرَادَ الْبَرَازَ انْطَلَقَ حَتَّی لَا يَرَاهُ أَحَدٌ

Narrated Jabir ibn Abdullah: When the Prophet ﷺ felt the need of relieving himself, he went far off where no one could see him.

حَدَّثَنَا مُوسَی بْنُ إِسْمَعِيلَ حَدَّثَنَا حَمَّادٌ أَخْبَرَنَا أَبُو التَّيَّاحِ قَالَ حَدَّثَنِي شَيْخٌ قَالَ لَمَّا قَدِمَ عَبْدُ اللَّهِ بْنُ عَبَّاسٍ الْبَصْرَةَ فَکَانَ يُحَدِّثُ عَنْ أَبِي مُوسَی فَکَتَبَ عَبْدُ اللَّهِ إِلَی أَبِي مُوسَی يَسْأَلُهُ عَنْ أَشْيَائَ فَکَتَبَ إِلَيْهِ أَبُو مُوسَی إِنِّي کُنْتُ مَعَ رَسُولِ اللَّهِ صَلَّی اللَّهُ عَلَيْهِ وَسَلَّمَ ذَاتَ يَوْمٍ فَأَرَادَ أَنْ يَبُولَ فَأَتَی دَمِثًا فِي أَصْلِ جِدَارٍ فَبَالَ ثُمَّ قَالَ صَلَّی اللَّهُ عَلَيْهِ وَسَلَّمَ إِذَا أَرَادَ أَحَدُکُمْ أَنْ يَبُولَ فَلْيَرْتَدْ لِبَوْلِهِ مَوْضِعًا

Abu al-Tayyah reported on the authority of a shaykh (an old man): When Abdullah ibn Abbas came to Basrah, people narrated to him traditions from Abu Musa. Therefore Ibn Abbas wrote to him asking him about certain things. In reply Abu Musa wrote to him saying: One day I was in the company of the Messenger of Allah ﷺ. He wanted to urinate. Then he came to a soft ground at the foot of a wall and urinated. He (the Prophet) then said: If any of you wants to urinate, he should look for a place (like this) for his urination.

حَدَّثَنَا مُسَدَّدُ بْنُ مُسَرْهَدٍ حَدَّثَنَا حَمَّادُ بْنُ زَيْدٍ وَعَبْدُ الْوَارِثِ عَنْ عَبْدِ الْعَزِيزِ بْنِ صُهَيْبٍ عَنْ أَنَسِ بْنِ مَالِکٍ قَالَ کَانَ رَسُولُ اللَّهِ صَلَّی اللَّهُ عَلَيْهِ وَسَلَّمَ إِذَا دَخَلَ الْخَلَائَ قَالَ عَنْ حَمَّادٍ قَالَ اللَّهُمَّ إِنِّي أَعُوذُ بِکَ وَقَالَ عَنْ عَبْدِ الْوَارِثِ قَالَ أَعُوذُ بِاللَّهِ مِنْ الْخُبُثِ وَالْخَبَائِثِ

Anas bin Malik reported: When the Messenger of Allah ﷺ entered the toilet, he used to say (before entering): "O Allaah, I seek refuge in Thee. " This is according to the version of Hammad. Abd al-Warith has another version: "I seek refuge in Allaah from male and female devils. "

اَنَسِ بْنِ مَالِکٍ، ← عَبْدِ الْعَزِيزِ بْنِ صُهَيْبٍ ← حَمَّادُ بْنُ زَيْدٍ وَعَبْدُ الْوَارِثِ ← مُسَدَّدُ بْنُ مُسَرْهَدٍ،
