حَدَّثَنَا حَفْصُ بْنُ عُمَرَ حَدَّثَنَا شُعْبَةُ ح و حَدَّثَنَا ابْنُ کَثِيرٍ أَخْبَرَنَا شُعْبَةُ أَخْبَرَنِي مُحَمَّدٌ أَوْ عَبْدُ اللَّهِ بْنُ مُجَالِدٍ قَالَ اخْتَلَفَ عَبْدُ اللَّهِ بْنُ شَدَّادٍ وَأَبُو بُرْدَةَ فِي السَّلَفِ فَبَعَثُونِي إِلَی ابْنِ أَبِي أَوْفَی فَسَأَلْتُهُ فَقَالَ إِنْ کُنَّا نُسْلِفُ عَلَی عَهْدِ رَسُولِ اللَّهِ صَلَّی اللَّهُ عَلَيْهِ وَسَلَّمَ وَأَبِي بَکْرٍ وَعُمَرَ فِي الْحِنْطَةِ وَالشَّعِيرِ وَالتَّمْرِ وَالزَّبِيبِ زَادَ ابْنُ کَثِيرٍ إِلَی قَوْمٍ مَا هُوَ عِنْدَهُمْ ثُمَّ اتَّفَقَا وَسَأَلْتُ ابْنَ أَبْزَي فَقَالَ مِثْلَ ذَلِکَ

Muhammad or Abdullah bin Mujahid said: Abdullah bin Shaddad and Abu Burdah disputed over salaf (payment in advance). They sent me to Ibn Abi Awfa and I asked him (about it) and he replied: We used to pay in advance (salaf) during the time of the Messenger of Allah ﷺ, Abu Bakr and Umar in wheat, barley, dates and raisins. Ibn Kathir added: "to those people who did not possess these things. " The agreed version then goes: I then asked Ibn Abza who gave a similar reply.

حَدَّثَنَا مُحَمَّدُ بْنُ بَشَّارٍ حَدَّثَنَا يَحْيَی وَابْنُ مَهْدِيٍّ قَالَا حَدَّثَنَا شُعْبَةُ عَنْ عَبْدِ اللَّهِ بْنِ أَبِي الْمُجَالِدِ وَقَالَ عَبْدُ الرَّحْمَنِ عَنْ ابْنِ أَبِي الْمُجَالِدِ بِهَذَا الْحَدِيثِ قَالَ عِنْدَ قَوْمٍ مَا هُوَ عِنْدَهُمْ قَالَ أَبُو دَاوُد الصَّوَابُ ابْنُ أَبِي الْمُجَالِدِ وَشُعْبَةُ أَخْطَأَ فِيهِ

The tradition mentioned above has also been transmitted by Ibn Abi al-Mujahid through a different chain of narrators. This version has: "to those people who did not possess these things. " Abu Dawud said: What is correct is Ibn Abi al-Mujahid. Shubah made a mistake in it.

حَدَّثَنَا مُحَمَّدُ بْنُ الْمُصَفَّی حَدَّثَنَا أَبُو الْمُغِيرَةِ حَدَّثَنَا عَبْدُ الْمَلِکِ بْنُ أَبِي غَنِيَّةَ حَدَّثَنِي أَبُو إِسْحَقَ عَنْ عَبْدِ اللَّهِ بْنِ أَبِي أَوْفَی الْأَسْلَمِيِّ قَالَ غَزَوْنَا مَعَ رَسُولِ اللَّهِ صَلَّی اللَّهُ عَلَيْهِ وَسَلَّمَ الشَّامَ فَکَانَ يَأْتِينَا أَنْبَاطٌ مِنْ أَنْبَاطِ الشَّامِ فَنُسْلِفُهُمْ فِي الْبُرِّ وَالزَّيْتِ سِعْرًا مَعْلُومًا وَأَجَلًا مَعْلُومًا فَقِيلَ لَهُ مِمَّنْ لَهُ ذَلِکَ قَالَ مَا کُنَّا نَسْأَلُهُمْ

Narrated Abdullah ibn Abu Awfa ibn Abu Awfa al-Aslami: We made a journey to Syria on an expedition along with the Messenger of Allah ﷺ. The Nabateans of Syria came to us and we paid in advance to them (in a salam contract) in wheat and olive oil at a specified rate and for a specified time. He asked (by the people): you might have contracted with him who had these things in his possession? He replied: We did not ask them.

حَدَّثَنَا مُحَمَّدُ بْنُ کَثِيرٍ أَخْبَرَنَا سُفْيَانُ عَنْ أَبِي إِسْحَقَ عَنْ رَجُلٍ نَجْرَانِيٍّ عَنْ ابْنِ عُمَرَ أَنَّ رَجُلًا أَسْلَفَ رَجُلًا فِي نَخْلٍ فَلَمْ تُخْرِجْ تِلْکَ السَّنَةَ شَيْئًا فَاخْتَصَمَا إِلَی النَّبِيِّ صَلَّی اللَّهُ عَلَيْهِ وَسَلَّمَ فَقَالَ بِمَ تَسْتَحِلُّ مَالَهُ ارْدُدْ عَلَيْهِ مَالَهُ ثُمَّ قَالَ لَا تُسْلِفُوا فِي النَّخْلِ حَتَّی يَبْدُوَ صَلَاحُهُ

Narrated Abdullah ibn Umar: A man paid in advance for a palm-tree. It did not bear fruit that year. They brought their case for decision to the Prophet ﷺ. He said: for which do you make his property lawful? He then said: Do not pay in advance for a palm-tree till they (the fruits) were clearly in good condition.

حَدَّثَنَا مُحَمَّدُ بْنُ عِيسَی حَدَّثَنَا أَبُو بَدْرٍ عَنْ زِيَادِ بْنِ خَيْثَمَةَ عَنْ سَعْدٍ يَعْنِي الطَّائِيَّ عَنْ عَطِيَّةَ بْنِ سَعْدٍ عَنْ أَبِي سَعِيدٍ الْخُدْرِيِّ قَالَ قَالَ رَسُولُ اللَّهِ صَلَّی اللَّهُ عَلَيْهِ وَسَلَّمَ مَنْ أَسْلَفَ فِي شَيْئٍ فَلَا يَصْرِفْهُ إِلَی غَيْرِهِ

Narrated Abu Saeed al-Khudri: The Prophet ﷺ said: If anyone pays in advance he must not transfer it to someone else before he receives it.

حَدَّثَنَا قُتَيْبَةُ بْنُ سَعِيدٍ حَدَّثَنَا اللَّيْثُ عَنْ بُکَيْرٍ عَنْ عِيَاضِ بْنِ عَبْدِ اللَّهِ عَنْ أَبِي سَعِيدٍ الْخُدْرِيِّ أَنَّهُ قَالَ أُصِيبَ رَجُلٌ فِي عَهْدِ رَسُولِ اللَّهِ صَلَّی اللَّهُ عَلَيْهِ وَسَلَّمَ فِي ثِمَارٍ ابْتَاعَهَا فَکَثُرَ دَيْنُهُ فَقَالَ رَسُولُ اللَّهِ صَلَّی اللَّهُ عَلَيْهِ وَسَلَّمَ تَصَدَّقُوا عَلَيْهِ فَتَصَدَّقَ النَّاسُ عَلَيْهِ فَلَمْ يَبْلُغْ ذَلِکَ وَفَائَ دَيْنِهِ فَقَالَ رَسُولُ اللَّهِ صَلَّی اللَّهُ عَلَيْهِ وَسَلَّمَ خُذُوا مَا وَجَدْتُمْ وَلَيْسَ لَکُمْ إِلَّا ذَلِکَ

Narrated Abu Saeed Al Khudri: In the time of the Messenger of Allah ﷺ a man suffered loss affecting fruits he had bought and owed a large debt, so the Messenger of Allah ﷺ said: Give him sadaqah (alms). So the people gave him sadaqah (alms), but as that was not enough to pay the debt in full, the Messenger of Allah ﷺ said: Take what you find. But that is all you may have.

رَسُولُ اللَّهِ تَصَدَّقُوا عَلَيْهِ فَتَصَدَّقَ النَّاسُ عَلَيْهِ فَلَمْ يَبْلُغْ ذَلِکَ وَفَائَ دَيْنِهِ ← أُصِيبَ رَجُلٌ، فِي عَهْدِ رَسُولِ اللَّهِ فِي ثِمَارٍ ابْتَاعَهَا، فَكَثُرَ دَيْنُهُ، ← أَبِي سَعِيدٍ الْخُدْرِيِّ، أَنَّهُ ← عِيَاضِ بْنِ عَبْدِ اللَّهِ، ← بُكَيْرٍ، ← اللَّيْثُ ← قُتَيْبَةُ بْنُ سَعِيدٍ

حَدَّثَنَا سُلَيْمَانُ بْنُ دَاوُدَ الْمَهْرِيُّ وَأَحْمَدُ بْنُ سَعِيدٍ الْهَمْدَانِيُّ قَالَا أَخْبَرَنَا ابْنُ وَهْبٍ قَالَ أَخْبَرَنِي ابْنُ جُرَيْجٍ ح و حَدَّثَنَا مُحَمَّدُ بْنُ مَعْمَرٍ حَدَّثَنَا أَبُو عَاصِمٍ عَنْ ابْنِ جُرَيْجٍ الْمَعْنَی أَنَّ أَبَا الزُّبَيْرِ الْمَکِّيَّ أَخْبَرَهُ عَنْ جَابِرِ بْنِ عَبْدِ اللَّهِ أَنَّ رَسُولَ اللَّهِ صَلَّی اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ إِنْ بِعْتَ مِنْ أَخِيکَ تَمْرًا فَأَصَابَتْهَا جَائِحَةٌ فَلَا يَحِلُّ لَکَ أَنْ تَأْخُذَ مِنْهُ شَيْئًا بِمَ تَأْخُذُ مَالَ أَخِيکَ بِغَيْرِ حَقٍّ

Narrated Jabir bin Abdullah: The Messenger of Allah ﷺ as saying: If you were to sell dried dates to your brother and they were smitten by blight, it will not be allowable for you to take your brother's property unjustly.

جَابِرِ بْنِ عَبْدِ اللَّهِ: ← ابْنِ جُرَيْجٍ الْمَعْنَی أَنَّ أَبَا الزُّبَيْرِ الْمَکِّيَّ ← أَبُو عَاصِمٍ ← مُحَمَّدُ بْنُ مَعْمَرٍ، ← و، ← ابْنُ جُرَيْجٍ، ← ابْنُ وَهْبٍ، ← سُلَيْمَانُ بْنُ دَاوُدَ الْمَهْرِيُّ وَأَحْمَدُ بْنُ سَعِيدٍ الْهَمْدَانِيُّ

حَدَّثَنَا سُلَيْمَانُ بْنُ دَاوُدَ الْمَهْرِيُّ أَخْبَرَنَا ابْنُ وَهْبٍ أَخْبَرَنِي عُثْمَانُ بْنُ الْحَکَمِ عَنْ ابْنِ جُرَيْجٍ عَنْ عَطَائٍ قَالَ الْجَوَائِحُ کُلُّ ظَاهِرٍ مُفْسِدٍ مِنْ مَطَرٍ أَوْ بَرَدٍ أَوْ جَرَادٍ أَوْ رِيحٍ أَوْ حَرِيقٍ

Ata said: Blight means anything which obviously damages (the crop), by rain, hail, locust, blast of wind, or fire.

عَطَائٍ ← ابْنُ جُرَيْجٍ، ← عُثْمَانُ بْنُ الْحَکَمِ ← ابْنُ وَهْبٍ، ← سُلَيْمَانُ بْنُ دَاوُدَ الْمَهْرِيُّ

حَدَّثَنَا سُلَيْمَانُ بْنُ دَاوُدَ أَخْبَرَنَا ابْنُ وَهْبٍ أَخْبَرَنِي عُثْمَانُ بْنُ الْحَکَمِ عَنْ يَحْيَی بْنِ سَعِيدٍ أَنَّهُ قَالَ لَا جَائِحَةَ فِيمَا أُصِيبَ دُونَ ثُلُثِ رَأْسِ الْمَالِ قَالَ يَحْيَی وَذَلِکَ فِي سُنَّةِ الْمُسْلِمِينَ

Yahya bin Saeed said: Blight is not effective when less than one-third of goods are damaged. Yayha said: That has been the established practice of Muslims.

يَحْيَی وَذَلِکَ فِي سُنَّةِ الْمُسْلِمِينَ ← لَا جَائِحَةَ فِيمَا أُصِيبَ دُونَ ثُلُثِ رَأْسِ الْمَالِ ← يَحْيَی بْنِ سَعِيدٍ أَنَّهُ ← عُثْمَانُ بْنُ الْحَکَمِ ← ابْنُ وَهْبٍ، ← سُلَيْمَانَ بْنِ دَاوُدَ،

حَدَّثَنَا عُثْمَانُ بْنُ أَبِي شَيْبَةَ حَدَّثَنَا جَرِيرٌ عَنْ الْأَعْمَشِ عَنْ أَبِي صَالِحٍ عَنْ أَبِي هُرَيْرَةَ قَالَ قَالَ رَسُولُ اللَّهِ صَلَّی اللَّهُ عَلَيْهِ وَسَلَّمَ لَا يُمْنَعُ فَضْلُ الْمَائِ لِيُمْنَعَ بِهِ الْکَلَأُ

Narrated Abu Hurairah: The Messenger of Allah ﷺ as saying: Excess water should not be withheld so as to prevent (cattle) by it from grass.

أَبِي هُرَيْرَةَ، ← اَبِیْ صَالِحٍ ← الْاَعْمَشِ ← جَرِيرٌ ← عُثْمَانُ بْنُ أَبِي شَيْبَةَ

حَدَّثَنَا أَبُو بَکْرِ بْنُ أَبِي شَيْبَةَ حَدَّثَنَا وَکِيعٌ حَدَّثَنَا الْأَعْمَشُ عَنْ أَبِي صَالِحٍ عَنْ أَبِي هُرَيْرَةَ قَالَ قَالَ رَسُولُ اللَّهِ صَلَّی اللَّهُ عَلَيْهِ وَسَلَّمَ ثَلَاثَةٌ لَا يُکَلِّمُهُمْ اللَّهُ يَوْمَ الْقِيَامَةِ رَجُلٌ مَنَعَ ابْنَ السَّبِيلِ فَضْلَ مَائٍ عِنْدَهُ وَرَجُلٌ حَلَفَ عَلَی سِلْعَةٍ بَعْدَ الْعَصْرِ يَعْنِي کَاذِبًا وَرَجُلٌ بَايَعَ إِمَامًا فَإِنْ أَعْطَاهُ وَفَی لَهُ وَإِنْ لَمْ يُعْطِهِ لَمْ يَفِ لَهُ

Narrated Abu Hurairah: The Messenger of Allah ﷺ as saying: There are three people who Allah will not address on the Day of Judgement: a man who prevents traveller from the excess water which he has with him; and a man who swears for the goods (for sale) after the afternoon prayer, that is, (he swears) falsely; and a man who takes the oath of allegiance to a ruler (imam); if he gives him (something), he fullfils (the oath of allegiance) to him, if he does not give him (anything), he does not fulfill it.

أَبِي هُرَيْرَةَ، ← اَبِیْ صَالِحٍ ← الْاَعْمَشِ ← وَكِيعٌ، ← أَبُو بَكْرِ بْنُ أَبِي شَيْبَةَ،

سنن ابودوٗد · كِتَابُ الْإِجَارَةِ ‹ باب · حديث 3475

حَدَّثَنَا عُثْمَانُ بْنُ أَبِي شَيْبَةَ حَدَّثَنَا جَرِيرٌ عَنْ الْأَعْمَشِ بِإِسْنَادِهِ وَمَعْنَاهُ قَالَ وَلَا يُزَکِّيهِمْ وَلَهُمْ عَذَابٌ أَلِيمٌ وَقَالَ فِي السِّلْعَةِ بِاللَّهِ لَقَدْ أُعْطِيَ بِهَا کَذَا وَکَذَا فَصَدَّقَهُ الْآخَرُ فَأَخَذَهَا

The tradition mentioned above has also been related by al-'Amash to the same effect through a different chain of narrators. This version adds: "He used: 'Not purify them ; grievously will be their penalty. '" He said about (selling) the goods: I swear by Allah, I was given (the price) so and so for it. The other man considered it to be correct and bought it.

وَلَا يُزَکِّيهِمْ وَلَهُمْ عَذَابٌ أَلِيمٌ ← الْأَعْمَشِ بِإِسْنَادِهِ وَمَعْنَاهُ ← جَرِيرٌ ← عُثْمَانُ بْنُ أَبِي شَيْبَةَ
