قَالَ الْحَارِثُ بْنُ مِسْکِينٍ قِرَائَةً عَلَيْهِ وَأَنَا أَسْمَعُ عَنْ ابْنِ الْقَاسِمِ حَدَّثَنِي مَالِکٌ عَنْ ابْنِ شِهَابٍ عَنْ سُلَيْمَانَ بْنِ يَسَارٍ عَنْ عَبْدِ اللَّهِ بْنِ عَبَّاسٍ قَالَ کَانَ الْفَضْلُ بْنُ عَبَّاسٍ رَدِيفَ رَسُولِ اللَّهِ صَلَّی اللَّهُ عَلَيْهِ وَسَلَّمَ فَجَائَتْهُ امْرَأَةٌ مِنْ خَثْعَمَ تَسْتَفْتِيهِ فَجَعَلَ الْفَضْلُ يَنْظُرُ إِلَيْهَا وَتَنْظُرُ إِلَيْهِ وَجَعَلَ رَسُولُ اللَّهِ صَلَّی اللَّهُ عَلَيْهِ وَسَلَّمَ يَصْرِفُ وَجْهَ الْفَضْلِ إِلَی الشِّقِّ الْآخَرِ فَقَالَتْ يَا رَسُولَ اللَّهِ إِنَّ فَرِيضَةَ اللَّهِ عَزَّ وَجَلَّ عَلَی عِبَادِهِ فِي الْحَجِّ أَدْرَکَتْ أَبِي شَيْخًا کَبِيرًا لَا يَسْتَطِيعُ أَنْ يَثْبُتَ عَلَی الرَّاحِلَةِ أَفَأَحُجُّ عَنْهُ قَالَ نَعَمْ وَذَلِکَ فِي حَجَّةِ الْوَدَاعِ

It was narrated that ‘Abdullah bin ‘Abbas said: “Al Fadi bin ‘Abbas was riding behind the Messenger of Allah صلی اللہ علیہ وآلہ وسلم when a woman from Khath’am came to ask him a question. Al-Fadl started looking at her, and she at him, and the Messenger of Allah صلی اللہ علیہ وآلہ وسلم turned the face of Al-Fadl the other way. She said: ‘Messenger of Allah صلی اللہ علیہ وآلہ وسلم, the command of Allah, the Mighty and Sublime, to His slaves to perform Hajj has come while my father is an old man, and he cannot sit firmly in the saddle; can I i Hajj on his behalf?’ He said: ‘Yes.’ That was during the Farewell Pilgrimage.” (Sahih)

أَخْبَرَنَا أَبُو دَاوُدَ قَالَ حَدَّثَنَا يَعْقُوبُ بْنُ إِبْرَاهِيمَ قَالَ حَدَّثَنِي أَبِي عَنْ صَالِحِ بْنِ کَيْسَانَ عَنْ ابْنِ شِهَابٍ أَنَّ سُلَيْمَانَ بْنَ يَسَارٍ أَخْبَرَهُ أَنَّ ابْنَ عَبَّاسٍ أَخْبَرَهُ أَنَّ امْرَأَةً مِنْ خَثْعَمَ قَالَتْ يَا رَسُولَ اللَّهِ إِنَّ فَرِيضَةَ اللَّهِ عَزَّ وَجَلَّ فِي الْحَجِّ عَلَی عِبَادِهِ أَدْرَکَتْ أَبِي شَيْخًا کَبِيرًا لَا يَسْتَوِي عَلَی الرَّاحِلَةِ فَهَلْ يَقْضِي عَنْهُ أَنْ أَحُجَّ عَنْهُ قَالَ لَهَا رَسُولُ اللَّهِ صَلَّی اللَّهُ عَلَيْهِ وَسَلَّمَ نَعَمْ فَأَخَذَ الْفَضْلُ يَلْتَفِتُ إِلَيْهَا وَکَانَتْ امْرَأَةً حَسْنَائَ وَأَخَذَ رَسُولُ اللَّهِ صَلَّی اللَّهُ عَلَيْهِ وَسَلَّمَ الْفَضْلَ فَحَوَّلَ وَجْهَهُ مِنْ الشِّقِّ الْآخَرِ

It was narrated from Ibn Shihab that Sulaiman bin Yasar told him that Ibn ‘Abbas told him that a woman from Khath’am said: “Messenger of Allah صلی اللہ علیہ وآلہ وسلم, the command of Allah, the Mighty and Sublime, to His slaves to perform Hajj has come while my father is an old man, and he cannot sit upright in the saddle. Will it discharge his duty if I perform Hajj on his behalf?” The Messenger of Allah صلی اللہ علیہ وآلہ وسلم said to her: “Yes.” Al-FadI starting turning toward her, for she was a beautiful woman, and the Messenger of Allah صلی اللہ علیہ وآلہ وسلم turned Al Fadl’s face to the other side. (Sahih)

أَخْبَرَنَا مُجَاهِدُ بْنُ مُوسَی عَنْ هُشَيْمٍ عَنْ يَحْيَی بْنِ أَبِي إِسْحَقَ عَنْ سُلَيْمَانَ بْنِ يَسَارٍ عَنْ عَبْدِ اللَّهِ بْنِ عَبَّاسٍ أَنَّ رَجُلًا سَأَلَ النَّبِيَّ صَلَّی اللَّهُ عَلَيْهِ وَسَلَّمَ إِنَّ أَبِي أَدْرَکَهُ الْحَجُّ وَهُوَ شَيْخٌ کَبِيرٌ لَا يَثْبُتُ عَلَی رَاحِلَتِهِ فَإِنْ شَدَدْتُهُ خَشِيتُ أَنْ يَمُوتَ أَفَأَحُجُّ عَنْهُ قَالَ أَفَرَأَيْتَ لَوْ کَانَ عَلَيْهِ دَيْنٌ فَقَضَيْتَهُ أَکَانَ مُجْزِئًا قَالَ نَعَمْ قَالَ فَحُجَّ عَنْ أَبِيکَ

It was narrated from ‘Abdullah bin ‘Abbas that a man asked the Messenger of Allah صلی اللہ علیہ وآلہ وسلم : “The (command to perform) IIajj has come while my father is an old man and cannot sit firmly in the saddle, and if I tie him, I fear that he may die. Can I perform Hajj on his behalf?” He said: “Do you think that if he owed a debt you would pay it off for him?” He said: “Yes.” He said: “Then perform Hajj on behalf of y our father.”(Sahih).

أَخْبَرَنَا أَحْمَدُ بْنُ سُلَيْمَانَ قَالَ حَدَّثَنَا يَزِيدُ قَالَ حَدَّثَنَا هِشَامٌ عَنْ مُحَمَّدٍ عَنْ يَحْيَی بْنِ أَبِي إِسْحَقَ عَنْ سُلَيْمَانَ بْنِ يَسَارٍ عَنْ الْفَضْلِ بْنِ الْعَبَّاسِ أَنَّهُ کَانَ رَدِيفَ النَّبِيِّ صَلَّی اللَّهُ عَلَيْهِ وَسَلَّمَ فَجَائَهُ رَجُلٌ فَقَالَ يَا رَسُولَ اللَّهِ إِنَّ أُمِّي عَجُوزٌ کَبِيرَةٌ إِنْ حَمَلْتُهَا لَمْ تَسْتَمْسِکْ وَإِنْ رَبَطْتُهَا خَشِيتُ أَنْ أَقْتُلَهَا فَقَالَ رَسُولُ اللَّهِ صَلَّی اللَّهُ عَلَيْهِ وَسَلَّمَ أَرَأَيْتَ لَوْ کَانَ عَلَی أُمِّکَ دَيْنٌ أَکُنْتَ قَاضِيَهُ قَالَ نَعَمْ قَالَ فَحُجَّ عَنْ أُمِّکَ

It was narrated from Al-Fadl bin ‘Abbas, that he was riding behind the Messenger of Allah صلی اللہ علیہ وآلہ وسلم when a man came and said: “Messenger of Allah صلی اللہ علیہ وآلہ وسلم, my mother is an old woman; if I put her on a mount she cannot sit firmly, and if I tie her, I fear that I may kill her.” He said: “Do you think that if your mother owed a debt you would pay it off for her?” He said: “Yes.” He said: “Then perform -Iajj on behalf of your mother.” (SahIih)

أَخْبَرَنَا أَبُو دَاوُدَ قَالَ حَدَّثَنَا الْوَلِيدُ بْنُ نَافِعٍ قَالَ حَدَّثَنَا شُعْبَةُ عَنْ يَحْيَی بْنِ أَبِي إِسْحَقَ قَالَ سَمِعْتُ سُلَيْمَانَ بْنَ يَسَارٍ يُحَدِّثُهُ عَنْ الْفَضْلِ بْنِ الْعَبَّاسِ قَالَ جَائَ رَجُلٌ إِلَی النَّبِيِّ صَلَّی اللَّهُ عَلَيْهِ وَسَلَّمَ فَقَالَ يَا نَبِيَّ اللَّهِ إِنَّ أَبِي شَيْخٌ کَبِيرٌ لَا يَسْتَطِيعُ الْحَجَّ وَإِنْ حَمَلْتُهُ لَمْ يَسْتَمْسِکْ أَفَأَحُجُّ عَنْهُ قَالَ حُجَّ عَنْ أَبِيکَ قَالَ أَبُو عَبْد الرَّحْمَنِ سُلَيْمَانُ لَمْ يَسْمَعْ مِنْ الْفَضْلِ بْنِ الْعَبَّاسِ

It was narrated from Sulaiman bin Yasar, who narrated from Al-FadI bin ‘Abbas, who said: “A man came to the Prophet صلی اللہ علیہ وآلہ وسلم and said: ‘Prophet of Allah صلی اللہ علیہ وآلہ وسلم, my father is an old man and cannot perform Hajj.’ If I put him on a mount he cannot sit firm. Can I perform Hajj on his behalf? He said: “Perform Hajj on behalf of your father.” (Sahih) Abu ‘Abdur-Rahman (An-Nasa’i) ….d: Sulaiman did not hear from I bin Al-’Abbas.

It was narrated from Ibn Abbas that a man came to the and said: “My father is an old man, can I perform Hajj on his behalf?” He said: “Yes. Don’t you think that if he owed a debt and you paid it off, that would suffice him?” (Sahih)

أَخْبَرَنَا مُحَمَّدُ بْنُ الْعَلَائِ قَالَ حَدَّثَنَا أَبُو مُعَاوِيَةَ عَنْ الْأَعْمَشِ عَنْ عُمَارَةَ هُوَ ابْنُ عُمَيْرٍ عَنْ عَبْدِ الرَّحْمَنِ بْنِ يَزِيدَ قَالَ أَکْثَرُوا عَلَی عَبْدِ اللَّهِ ذَاتَ يَوْمٍ فَقَالَ عَبْدُ اللَّهِ إِنَّهُ قَدْ أَتَی عَلَيْنَا زَمَانٌ وَلَسْنَا نَقْضِي وَلَسْنَا هُنَالِکَ ثُمَّ إِنَّ اللَّهَ عَزَّ وَجَلَّ قَدَّرَ عَلَيْنَا أَنْ بَلَغْنَا مَا تَرَوْنَ فَمَنْ عَرَضَ لَهُ مِنْکُمْ قَضَائٌ بَعْدَ الْيَوْمِ فَلْيَقْضِ بِمَا فِي کِتَابِ اللَّهِ فَإِنْ جَائَ أَمْرٌ لَيْسَ فِي کِتَابِ اللَّهِ فَلْيَقْضِ بِمَا قَضَی بِهِ نَبِيُّهُ صَلَّی اللَّهُ عَلَيْهِ وَسَلَّمَ فَإِنْ جَائَ أَمْرٌ لَيْسَ فِي کِتَابِ اللَّهِ وَلَا قَضَی بِهِ نَبِيُّهُ صَلَّی اللَّهُ عَلَيْهِ وَسَلَّمَ فَلْيَقْضِ بِمَا قَضَی بِهِ الصَّالِحُونَ فَإِنْ جَائَ أَمْرٌ لَيْسَ فِي کِتَابِ اللَّهِ وَلَا قَضَی بِهِ نَبِيُّهُ صَلَّی اللَّهُ عَلَيْهِ وَسَلَّمَ وَلَا قَضَی بِهِ الصَّالِحُونَ فَلْيَجْتَهِدْ رَأْيَهُ وَلَا يَقُولُ إِنِّي أَخَافُ وَإِنِّي أَخَافُ فَإِنَّ الْحَلَالَ بَيِّنٌ وَالْحَرَامَ بَيِّنٌ وَبَيْنَ ذَلِکَ أُمُورٌ مُشْتَبِهَاتٌ فَدَعْ مَا يَرِيبُکَ إِلَی مَا لَا يَرِيبُکَ قَالَ أَبُو عَبْد الرَّحْمَنِ هَذَا الْحَدِيثُ جَيِّدٌ جَيِّدٌ

It was narrated that ‘Abdur Rahman bin Yazid said: “The people asked ‘Abdullah too many questions one day, and ‘Abdullah said: ‘There was a time when we did not pass so many judgments, but now that time is over Now Allah, the Mighty and Sublime, has decreed that we reach a time when, as you see, (we are asked to pass many judgments). Whoever among you is asked to pass a judgment after this day, let him pass judgment according to what is in the Book of Allah. If he is faced with a matter that is not mentioned in the Book of Allah, let him pass judgment according to the way His Prophet صلی اللہ علیہ وآلہ وسلم passed judgment. If he is faced with a matter that is not mentioned in the Book of Allah and concerning which His Prophet صلی اللہ علیہ وآلہ وسلم did not pass judgment, then let him pass judgment according to the way the righteous passed judgment. If he is faced with a matter that is not mentioned in the Book of Allah, and concerning which His Prophet صلی اللہ علیہ وآلہ وسلم and the righteous did not pass judgment, then let him strive to work it out, and let him not say ‘I am afraid, I am afraid.’ For what which is lawful is clear and that which is unlawful is clear, and between them are matters which are not as clear. Leave that which makes you doubt for that which does not make you doubt.” IjIasan) Abu ‘Abdur-Rahman (An-Nasa’i) said: This Hadith is very good.

أَخْبَرَنِي مُحَمَّدُ بْنُ عَلِيِّ بْنِ مَيْمُونٍ قَالَ حَدَّثَنَا الْفِرْيَابِيُّ قَالَ حَدَّثَنَا سُفْيَانُ عَنْ الْأَعْمَشِ عَنْ عُمَارَةَ بْنِ عُمَيْرٍ عَنْ حُرَيْثِ بْنِ ظُهَيْرٍ عَنْ عَبْدِ اللَّهِ بْنِ مَسْعُودٍ قَالَ أَتَی عَلَيْنَا حِينٌ وَلَسْنَا نَقْضِي وَلَسْنَا هُنَالِکَ وَإِنَّ اللَّهَ عَزَّ وَجَلَّ قَدَّرَ أَنْ بَلَغْنَا مَا تَرَوْنَ فَمَنْ عَرَضَ لَهُ قَضَائٌ بَعْدَ الْيَوْمِ فَلْيَقْضِ فِيهِ بِمَا فِي کِتَابِ اللَّهِ فَإِنْ جَائَ أَمْرٌ لَيْسَ فِي کِتَابِ اللَّهِ فَلْيَقْضِ بِمَا قَضَی بِهِ نَبِيُّهُ فَإِنْ جَائَ أَمْرٌ لَيْسَ فِي کِتَابِ اللَّهِ وَلَمْ يَقْضِ بِهِ نَبِيُّهُ صَلَّی اللَّهُ عَلَيْهِ وَسَلَّمَ فَلْيَقْضِ بِمَا قَضَی بِهِ الصَّالِحُونَ وَلَا يَقُولُ أَحَدُکُمْ إِنِّي أَخَافُ وَإِنِّي أَخَافُ فَإِنَّ الْحَلَالَ بَيِّنٌ وَالْحَرَامَ بَيِّنٌ وَبَيْنَ ذَلِکَ أُمُورٌ مُشْتَبِهَةٌ فَدَعْ مَا يَرِيبُکَ إِلَی مَا لَا يَرِيبُکَ

It was narrated that ‘Abdullah bin Mas’ud said: “There was a time when we did not pass so many judgments, but now that time is over. Now Allah, the Mighty and Sublime, has decreed that we reach a time when, as you see, (we are asked to pass many judgments). أَخْبَرَنَا مُحَمَّدُ بْنُ بَشَّارٍ قَالَ حَدَّثَنَا أَبُو عَامِرٍ قَالَ حَدَّثَنَا سُفْيَانُ عَنْ الشَّيْبَانِيِّ عَنْ الشَّعْبِيِّ عَنْ شُرَيْحٍ أَنَّهُ کَتَبَ إِلَی عُمَرَ يَسْأَلُهُ فَکَتَبَ إِلَيْهِ أَنْ اقْضِ بِمَا فِي کِتَابِ اللَّهِ فَإِنْ لَمْ يَکُنْ فِي کِتَابِ اللَّهِ فَبِسُنَّةِ رَسُولِ اللَّهِ صَلَّی اللَّهُ عَلَيْهِ وَسَلَّمَ فَإِنْ لَمْ يَکُنْ فِي کِتَابِ اللَّهِ وَلَا فِي سُنَّةِ رَسُولِ اللَّهِ صَلَّی اللَّهُ عَلَيْهِ وَسَلَّمَ فَاقْضِ بِمَا قَضَی بِهِ الصَّالِحُونَ فَإِنْ لَمْ يَکُنْ فِي کِتَابِ اللَّهِ وَلَا فِي سُنَّةِ رَسُولِ اللَّهِ صَلَّی اللَّهُ عَلَيْهِ وَسَلَّمَ وَلَمْ يَقْضِ بِهِ الصَّالِحُونَ فَإِنْ شِئْتَ فَتَقَدَّمْ وَإِنْ شِئْتَ فَتَأَخَّرْ وَلَا أَرَی التَّأَخُّرَ إِلَّا خَيْرًا لَکَ وَالسَّلَامُ عَلَيْکُمْ

It was narrated from Shuraib that he wrote to ‘Umar, to ask him (a question), and ‘Umar wrote back to him telling him: “Judge according to what is in the Book of Allah. If it is not (mentioned) in the Book of Allah, then (judge) according to the Sunnah of the Messenger of Allah صلی اللہ علیہ وآلہ وسلم . If it is not (mentioned) in the Book of Allah or the Sunnah of the Messenger of Allah صلی اللہ علیہ وآلہ وسلم then pass judgment according to the way the righteous passed judgment. If it is not (mentioned) in the Book of Allah, or the Sunnah of the Messenger of Allah صلی اللہ علیہ وآلہ وسلم and the righteous did not pass judgment concerning it, then if you wish, go ahead (and try to work it out by yourself) or if you wish, leave it. And I think that leaving it is better for you. And peace be upon you.”(Sahih).

أَخْبَرَنَا الْحُسَيْنُ بْنُ حُرَيْثٍ قَالَ أَنْبَأَنَا الْفَضْلُ بْنُ مُوسَی عَنْ سُفْيَانَ بْنِ سَعِيدٍ عَنْ عَطَائِ بْنِ السَّائِبِ عَنْ سَعِيدِ بْنِ جُبَيْرٍ عَنْ ابْنِ عَبَّاسٍ قَالَ کَانَتْ مُلُوکٌ بَعْدَ عِيسَی ابْنِ مَرْيَمَ عَلَيْهِ الصَّلَاة وَالسَّلَامُ بَدَّلُوا التَّوْرَاةَ وَالْإِنْجِيلَ وَکَانَ فِيهِمْ مُؤْمِنُونَ يَقْرَئُونَ التَّوْرَاةَ قِيلَ لِمُلُوکِهِمْ مَا نَجِدُ شَتْمًا أَشَدَّ مِنْ شَتْمٍ يَشْتِمُونَّا هَؤُلَائِ إِنَّهُمْ يَقْرَئُونَ وَمَنْ لَمْ يَحْکُمْ بِمَا أَنْزَلَ اللَّهُ فَأُولَئِکَ هُمْ الْکَافِرُونَ وَهَؤُلَائِ الْآيَاتِ مَعَ مَا يَعِيبُونَّا بِهِ فِي أَعْمَالِنَا فِي قِرَائَتِهِمْ فَادْعُهُمْ فَلْيَقْرَئُوا کَمَا نَقْرَأُ وَلْيُؤْمِنُوا کَمَا آمَنَّا فَدَعَاهُمْ فَجَمَعَهُمْ وَعَرَضَ عَلَيْهِمْ الْقَتْلَ أَوْ يَتْرُکُوا قِرَائَةَ التَّوْرَاةِ وَالْإِنْجِيلِ إِلَّا مَا بَدَّلُوا مِنْهَا فَقَالُوا مَا تُرِيدُونَ إِلَی ذَلِکَ دَعُونَا فَقَالَتْ طَائِفَةٌ مِنْهُمْ ابْنُوا لَنَا أُسْطُوَانَةً ثُمَّ ارْفَعُونَا إِلَيْهَا ثُمَّ اعْطُونَا شَيْئًا نَرْفَعُ بِهِ طَعَامَنَا وَشَرَابَنَا فَلَا نَرِدُ عَلَيْکُمْ وَقَالَتْ طَائِفَةٌ مِنْهُمْ دَعُونَا نَسِيحُ فِي الْأَرْضِ وَنَهِيمُ وَنَشْرَبُ کَمَا يَشْرَبُ الْوَحْشُ فَإِنْ قَدَرْتُمْ عَلَيْنَا فِي أَرْضِکُمْ فَاقْتُلُونَا وَقَالَتْ طَائِفَةٌ مِنْهُمْ ابْنُوا لَنَا دُورًا فِي الْفَيَافِي وَنَحْتَفِرُ الْآبَارَ وَنَحْتَرِثُ الْبُقُولَ فَلَا نَرِدُ عَلَيْکُمْ وَلَا نَمُرُّ بِکُمْ وَلَيْسَ أَحَدٌ مِنْ الْقَبَائِلِ إِلَّا وَلَهُ حَمِيمٌ فِيهِمْ قَالَ فَفَعَلُوا ذَلِکَ فَأَنْزَلَ اللَّهُ عَزَّ وَجَلَّ وَرَهْبَانِيَّةً ابْتَدَعُوهَا مَا کَتَبْنَاهَا عَلَيْهِمْ إِلَّا ابْتِغَائَ رِضْوَانِ اللَّهِ فَمَا رَعَوْهَا حَقَّ رِعَايَتِهَا وَالْآخَرُونَ قَالُوا نَتَعَبَّدُ کَمَا تَعَبَّدَ فُلَانٌ وَنَسِيحُ کَمَا سَاحَ فُلَانٌ وَنَتَّخِذُ دُورًا کَمَا اتَّخَذَ فُلَانٌ وَهُمْ عَلَی شِرْکِهِمْ لَا عِلْمَ لَهُمْ بِإِيمَانِ الَّذِينَ اقْتَدَوْا بِهِ فَلَمَّا بَعَثَ اللَّهُ النَّبِيَّ صَلَّی اللَّهُ عَلَيْهِ وَسَلَّمَ وَلَمْ يَبْقَ مِنْهُمْ إِلَّا قَلِيلٌ انْحَطَّ رَجُلٌ مِنْ صَوْمَعَتِهِ وَجَائَ سَائِحٌ مِنْ سِيَاحَتِهِ وَصَاحِبُ الدَّيْرِ مِنْ دَيْرِهِ فَآمَنُوا بِهِ وَصَدَّقُوهُ فَقَالَ اللَّهُ تَبَارَکَ وَتَعَالَی يَا أَيُّهَا الَّذِينَ آمَنُوا اتَّقُوا اللَّهَ وَآمِنُوا بِرَسُولِهِ يُؤْتِکُمْ کِفْلَيْنِ مِنْ رَحْمَتِهِ أَجْرَيْنِ بِإِيمَانِهِمْ بِعِيسَی وَبِالتَّوْرَاةِ وَالْإِنْجِيلِ وَبِإِيمَانِهِمْ بِمُحَمَّدٍ صَلَّی اللَّهُ عَلَيْهِ وَسَلَّمَ وَتَصْدِيقِهِمْ قَالَ يَجْعَلْ لَکُمْ نُورًا تَمْشُونَ بِهِ الْقُرْآنَ وَاتِّبَاعَهُمْ النَّبِيَّ صَلَّی اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ لِئَلَّا يَعْلَمَ أَهْلُ الْکِتَابِ يَتَشَبَّهُونَ بِکُمْ أَنْ لَا يَقْدِرُونَ عَلَی شَيْئٍ مِنْ فَضْلِ اللَّهِ الْآيَةَ

It was narrated that Ibn ‘Abbàs said: “There were kings after ‘Isa bin Mariam who altered the Tawráh and the InjIl, but there were among them believers who read the Tawrah. It was said to their kings: ‘We have never heard of any slander worse than that of those (believers) who slander us and recite: “And whosoever does not judge by what Allah has revealed, such are the disbelievers.” In these Verses, they are criticizing us for our deeds vhen they recite them.’ So he alled them together and gave them the choice between being put to death, or giving up reading the Tawrah and Injil, except for what bad been altered. They said: ‘Why do you want us to change? Leave us alone.’ Some of them said: ‘Build us a tower and let us go up there, and give us something to lift up our food and drink so we do not have to mix with you.’ Others said: ‘Let us go and wander throughout the land, and we will drink as the wild animals drink, and if you capture us in your land, you may kill us.’ Others said: ‘Build houses for us in the wilderness, and we will dig wells and grow vegetables, and we will not mix with you or pass by you, for there is no one of the tribes among whom we do not have close relatives.’ So they did that, and Allah revealed the words: ‘But the monasticism which they invented for themselves, We did not prescribe for them, but (they sought it) only to please Allah therewith, but that they did not observe it with the right observance.’ Then others said: ‘We will worship as so-and-so worshipped, and we will wander as so-and-so wandered, and we will adopt houses (in the wilderness) as so-and-so did.’ But they were still following their Shirk with no knowledge of the faith of those whom they claimed to be following. When Allah sent the Prophet صلی اللہ علیہ وآلہ وسلم , and there were only a few of them left, a man came down from his cell, and a wanderer came from his travels, and a monk came from his monastery, and they believed in him. And Allah said: ‘you who believe! Fear Allah, and believe in His Messenger (Muhammad), He will give you a double portion of His mercy — meaning, two rewards, because of their having believing in ‘Isa and in the Tawrah and Injil, and for having believing in Muhammad and He will give you a light by which you shall walk (straight), — meaning, the Qur’an, and their following the Prophet صلی اللہ علیہ وآلہ وسلم; and He said: ‘So that the people of the Scripture (Jews and Christians) may know that they have no power whatsoever over the Grace of Alah.” (Da’if)

أَخْبَرَنَا عَمْرُو بْنُ عَلِيٍّ قَالَ حَدَّثَنَا يَحْيَی قَالَ حَدَّثَنَا هِشَامُ بْنُ عُرْوَةَ قَالَ حَدَّثَنِي أَبِي عَنْ زَيْنَبَ بِنْتِ أَبِي سَلَمَةَ عَنْ أُمِّ سَلَمَةَ أَنَّ رَسُولَ اللَّهِ صَلَّی اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ إِنَّکُمْ تَخْتَصِمُونَ إِلَيَّ وَإِنَّمَا أَنَا بَشَرٌ وَلَعَلَّ بَعْضَکُمْ أَلْحَنُ بِحُجَّتِهِ مِنْ بَعْضٍ فَمَنْ قَضَيْتُ لَهُ مِنْ حَقِّ أَخِيهِ شَيْئًا فَلَا يَأْخُذْهُ فَإِنَّمَا أَقْطَعُهُ بِهِ قِطْعَةً مِنْ النَّارِ

It was narrated from Umm Salamah that the Messenger of Allah صلی اللہ علیہ وآلہ وسلم said: “You refer your disputes to me, but I am only human, and some of you may be more eloquent in arguing their case than others. If I pass judgment in favor of one of you, against his brother’s rights, let him not take it, for it is a piece of fire that I am giving him.” (Sahih)

أَخْبَرَنَا عِمْرَانُ بْنُ بَکَّارِ بْنِ رَاشِدٍ قَالَ حَدَّثَنَا عَلِيُّ بْنُ عَيَّاشٍ قَالَ حَدَّثَنَا شُعَيْبٌ قَالَ حَدَّثَنِي أَبُو الزِّنَادِ مِمَّا حَدَّثَهُ عَبْدُ الرَّحْمَنِ الْأَعْرَجُ مِمَّا ذَکَرَ أَنَّهُ سَمِعَ أَبَا هُرَيْرَةَ يُحَدِّثُ بِهِ عَنْ رَسُولِ اللَّهِ صَلَّی اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ وَقَالَ بَيْنَمَا امْرَأَتَانِ مَعَهُمَا ابْنَاهُمَا جَائَ الذِّئْبُ فَذَهَبَ بِابْنِ إِحْدَاهُمَا فَقَالَتْ هَذِهِ لِصَاحِبَتِهَا إِنَّمَا ذَهَبَ بِابْنِکِ وَقَالَتْ الْأُخْرَی إِنَّمَا ذَهَبَ بِابْنِکِ فَتَحَاکَمَتَا إِلَی دَاوُدَ عَلَيْهِ السَّلَام فَقَضَی بِهِ لِلْکُبْرَی فَخَرَجَتَا إِلَی سُلَيْمَانَ بْنِ دَاوُدَ فَأَخْبَرَتَاهُ فَقَالَ ائْتُونِي بِالسِّکِّينِ أَشُقُّهُ بَيْنَهُمَا فَقَالَتْ الصُّغْرَی لَا تَفْعَلْ يَرْحَمُکَ اللَّهُ هُوَ ابْنُهَا فَقَضَی بِهِ لِلصُّغْرَی قَالَ أَبُو هُرَيْرَةَ وَاللَّهِ مَا سَمِعْتُ بِالسِّکِّينِ قَطُّ إِلَّا يَوْمَئِذٍ مَا کُنَّا نَقُولُ إِلَّا الْمُدْيَةَ

Abu Hurairah narrated that the Messenger of Allah صلی اللہ علیہ وآلہ وسلم said: “There were two women who had two children, and the wolf came and took away the son of one of them. She said to her companion: ‘It took away your son.’ The other one said: ‘No, it took away your son.’ They referred the matter to Dawud, peace be upon him, for judgment (about the remaining child) and he ruled in favor of the older one. Then they went out to Sulaiman bin Dawud and told him (about that). He said: ‘Give me a knife and I will cut him in half (to be shared) between you.’ The younger one said: ‘Do not do that, may Allah have mercy on you; he is her son.’ So he ruled that (the child) belonged to the younger woman.” Abu Hurairah said: “By Allah! I never heard ‘Sikktn’ used until that day. We would only say: ‘Mudyah.”(Sahih).
