حَدَّثَنَا أَبُو کُرَيْبٍ حَدَّثَنَا عَبْدَةُ بْنُ سُلَيْمَانَ عَنْ مُحَمَّدِ بْنِ عَمْرٍو حَدَّثَنَا أَبُو سَلَمَةَ عَنْ أَبِي هُرَيْرَةَ قَالَ جَائَ مَاعِزٌ الْأَسْلَمِيُّ إِلَی رَسُولِ اللَّهِ صَلَّی اللَّهُ عَلَيْهِ وَسَلَّمَ فَقَالَ إِنَّهُ قَدْ زَنَی فَأَعْرَضَ عَنْهُ ثُمَّ جَائَ مِنْ شِقِّهِ الْآخَرِ فَقَالَ يَا رَسُولَ اللَّهِ إِنَّهُ قَدْ زَنَی فَأَعْرَضَ عَنْهُ ثُمَّ جَائَ مِنْ شِقِّهِ الْآخَرِ فَقَالَ يَا رَسُولَ اللَّهِ إِنَّهُ قَدْ زَنَی فَأَمَرَ بِهِ فِي الرَّابِعَةِ فَأُخْرِجَ إِلَی الْحَرَّةِ فَرُجِمَ بِالْحِجَارَةِ فَلَمَّا وَجَدَ مَسَّ الْحِجَارَةِ فَرَّ يَشْتَدُّ حَتَّی مَرَّ بِرَجُلٍ مَعَهُ لَحْيُ جَمَلٍ فَضَرَبَهُ بِهِ وَضَرَبَهُ النَّاسُ حَتَّی مَاتَ فَذَکَرُوا ذَلِکَ لِرَسُولِ اللَّهِ صَلَّی اللَّهُ عَلَيْهِ وَسَلَّمَ أَنَّهُ فَرَّ حِينَ وَجَدَ مَسَّ الْحِجَارَةِ وَمَسَّ الْمَوْتِ فَقَالَ رَسُولُ اللَّهِ صَلَّی اللَّهُ عَلَيْهِ وَسَلَّمَ هَلَّا تَرَکْتُمُوهُ قَالَ أَبُو عِيسَی هَذَا حَدِيثٌ حَسَنٌ وَقَدْ رُوِيَ مِنْ غَيْرِ وَجْهٍ عَنْ أَبِي هُرَيْرَةَ وَرُوِيَ هَذَا الْحَدِيثُ عَنْ الزُّهْرِيِّ عَنْ أَبِي سَلَمَةَ عَنْ جَابِرِ بْنِ عَبْدِ اللَّهِ عَنْ النَّبِيِّ صَلَّی اللَّهُ عَلَيْهِ وَسَلَّمَ نَحْوَ هَذَا

Narrated Abu Hurairah: Ma'iz Al-Aslamu came to the Messenger of Allah (ﷺ) and said that he had committed adultery, so he (ﷺ) turned away from him. Then he approached from his other side and said: '[O Messenger of Allah!] I have committed adultery.' So he turned away from him. The he came from his other side and said: 'O Messenger of Allah! I have committed adultery.' So he gave the order (for stoning) upon the fourth time. He was taken to Al-Harrah and stoned with rocks, he ran swiftly until he passed a man with a camel whip who beat him with it, and the people beat him until he died. They mentioned to the Messenger of Allah (ﷺ), that he ran upon feeling the rocks at the time of death. So the Messenger of Allah (ﷺ) said: 'Why didn't you leave him?'

حَدَّثَنَا بِذَلِکَ الْحَسَنُ بْنُ عَلِيٍّ حَدَّثَنَا عَبْدُ الرَّزَّاقِ أَنْبَأَنَا مَعْمَرٌ عَنْ الزُّهْرِيِّ عَنْ أَبِي سَلَمَةَ بْنِ عَبْدِ الرَّحْمَنِ عَنْ جَابِرِ بْنِ عَبْدِ اللَّهِ أَنَّ رَجُلًا مِنْ أَسْلَمَ جَائَ إِلَی النَّبِيِّ صَلَّی اللَّهُ عَلَيْهِ وَسَلَّمَ فَاعْتَرَفَ بِالزِّنَا فَأَعْرَضَ عَنْهُ ثُمَّ اعْتَرَفَ فَأَعْرَضَ عَنْهُ حَتَّی شَهِدَ عَلَی نَفْسِهِ أَرْبَعَ شَهَادَاتٍ فَقَالَ النَّبِيُّ صَلَّی اللَّهُ عَلَيْهِ وَسَلَّمَ أَبِکَ جُنُونٌ قَالَ لَا قَالَ أَحْصَنْتَ قَالَ نَعَمْ قَالَ فَأَمَرَ بِهِ فَرُجِمَ بِالْمُصَلَّی فَلَمَّا أَذْلَقَتْهُ الْحِجَارَةُ فَرَّ فَأُدْرِکَ فَرُجِمَ حَتَّی مَاتَ فَقَالَ لَهُ رَسُولُ اللَّهِ صَلَّی اللَّهُ عَلَيْهِ وَسَلَّمَ خَيْرًا وَلَمْ يُصَلِّ عَلَيْهِ قَالَ أَبُو عِيسَی هَذَا حَدِيثٌ حَسَنٌ صَحِيحٌ وَالْعَمَلُ عَلَی هَذَا الْحَدِيثِ عِنْدَ بَعْضِ أَهْلِ الْعِلْمِ أَنَّ الْمُعْتَرِفَ بِالزِّنَا إِذَا أَقَرَّ عَلَی نَفْسِهِ أَرْبَعَ مَرَّاتٍ أُقِيمَ عَلَيْهِ الْحَدُّ وَهُوَ قَوْلُ أَحْمَدَ وَإِسْحَقَ و قَالَ بَعْضُ أَهْلِ الْعِلْمِ إِذَا أَقَرَّ عَلَی نَفْسِهِ مَرَّةً أُقِيمَ عَلَيْهِ الْحَدُّ وَهُوَ قَوْلُ مَالِکِ بْنِ أَنَسٍ وَالشَّافِعِيِّ وَحُجَّةُ مَنْ قَالَ هَذَا الْقَوْلَ حَدِيثُ أَبِي هُرَيْرَةَ وَزَيْدِ بْنِ خَالِدٍ أَنَّ رَجُلَيْنِ اخْتَصَمَا إِلَی رَسُولِ اللَّهِ صَلَّی اللَّهُ عَلَيْهِ وَسَلَّمَ فَقَالَ أَحَدُهُمَا يَا رَسُولَ اللَّهِ إِنَّ ابْنِي زَنَی بِامْرَأَةِ هَذَا الْحَدِيثُ بِطُولِهِ وَقَالَ النَّبِيُّ صَلَّی اللَّهُ عَلَيْهِ وَسَلَّمَ اغْدُ يَا أُنَيْسُ عَلَی امْرَأَةِ هَذَا فَإِنْ اعْتَرَفَتْ فَارْجُمْهَا وَلَمْ يَقُلْ فَإِنْ اعْتَرَفَتْ أَرْبَعَ مَرَّاتٍ

Narrated Jabir bin 'Abdullah: A man from the tribe of Aslam came to the Prophet (ﷺ) and confessed adultery. He turned away from him, the he confessed (again). Then he turned away from him (again) until he had testified against himself four times. So the Prophet (ﷺ) said: Are you insane? He said: No He said: Are you married? He said: Yes . So he gave the order and he was stoned at the Musalla. He ran when he was stuck by the stones, and he was caught and stoned until he died. So the Messenger of Allah (ﷺ) spoke well of him but he did not perform the (funeral) Salat for him.
