أَخْبَرَنَا مُحَمَّدُ بْنُ مَعْمَرٍ قَالَ حَدَّثَنَا مُحَمَّدُ بْنُ کَثِيرٍ قَالَ حَدَّثَنَا سُلَيْمَانُ بْنُ کَثِيرٍ عَنْ عَمْرِو بْنِ دِينَارٍ عَنْ طَاوُسٍ عَنْ ابْنِ عَبَّاسٍ يَرْفَعُهُ قَالَ مَنْ قُتِلَ فِي عِمِّيَّةٍ أَوْ رِمِّيَّةٍ بِحَجَرٍ أَوْ سَوْطٍ أَوْ عَصًا فَعَقْلُهُ عَقْلُ الْخَطَإِ وَمَنْ قُتِلَ عَمْدًا فَهُوَ قَوَدٌ وَمَنْ حَالَ بَيْنَهُ وَبَيْنَهُ فَعَلَيْهِ لَعْنَةُ اللَّهِ وَالْمَلَائِکَةِ وَالنَّاسِ أَجْمَعِينَ لَا يَقْبَلُ اللَّهُ مِنْهُ صَرْفًا وَلَا عَدْلًا

It was narrated that Ibn ‘Abbas, who attributed it to the Prophet صلی اللہ علیہ وآلہ وسلم said: “Whoever is killed in the blind or by something thrown, with a rock, a whip, or a stick, then the blood money to be paid for him is the blood money for accidental killing. Whoever kills deliberately, then retaliation is upon him and whoever tries to prevent that, upon him is the curse of Allah,the Angels and all the people and Allah will not accept any arf nor ‘Ad! from him.” (Sahih)222

أَخْبَرَنَا مُحَمَّدُ بْنُ بَشَّارٍ قَالَ حَدَّثَنَا عَبْدُ الرَّحْمَنِ قَالَ حَدَّثَنَا شُعْبَةُ عَنْ أَيُّوبَ السَّخْتِيَانِيِّ عَنْ الْقَاسِمِ بْنِ رَبِيعَةَ عَنْ عَبْدِ اللَّهِ بْنِ عَمْرٍو عَنْ النَّبِيِّ صَلَّی اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ قَتِيلُ الْخَطَإِ شِبْهِ الْعَمْدِ بِالسَّوْطِ أَوْ الْعَصَا مِائَةٌ مِنْ الْإِبِلِ أَرْبَعُونَ مِنْهَا فِي بُطُونِهَا أَوْلَادُهَا

It was narrated from Al Qasim bin Rabi’ah, from ‘Abdullah bin ‘Amr, that the Prophet صلی اللہ علیہ وآلہ وسلم said: “The accidental killing, which seems intentional, with a whip or stick, (the Diyah) is one hundred camels, of which forty should be (she-camels) with their young in their wombs.” (Sahih)

أَخْبَرَنِي مُحَمَّدُ بْنُ إِسْمَعِيلَ بْنِ إِبْرَاهِيمَ قَالَ حَدَّثَنَا يُونُسُ قَالَ حَدَّثَنَا حَمَّادٌ عَنْ أَيُّوبَ عَنْ الْقَاسِمِ بْنِ رَبِيعَةَ أَنَّ رَسُولَ اللَّهِ صَلَّی اللَّهُ عَلَيْهِ وَسَلَّمَ خَطَبَ يَوْمَ الْفَتْحِ مُرْسَلٌ

It was narrated from Al Qasim bin Rabi’ah that the Messenger of Allah صلی اللہ علیہ وآلہ وسلم delivered a speech on the Day of the Conquest. (And he mentioned it) in Mursal form. (Sahih)

الْقَاسِمِ بْنِ رَبِيعَةَ، ← أَيُّوبَ ← حَمَّادٍ، ← يونس، ← مُحَمَّدُ بْنُ إِسْمَعِيلَ بْنِ إِبْرَاهِيمَ

أَخْبَرَنِي يَحْيَی بْنُ حَبِيبِ بْنِ عَرَبِيٍّ قَالَ أَنْبَأَنَا حَمَّادٌ عَنْ خَالِدٍ يَعْنِي الْحَذَّائَ عَنْ الْقَاسِمِ بْنِ رَبِيعَةَ عَنْ عُقْبَةَ بْنِ أَوْسٍ عَنْ عَبْدِ اللَّهِ أَنَّ رَسُولَ اللَّهِ صَلَّی اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ أَلَا وَإِنَّ قَتِيلَ الْخَطَإِ شِبْهِ الْعَمْدِ مَا کَانَ بِالسَّوْطِ وَالْعَصَا مِائَةٌ مِنْ الْإِبِلِ أَرْبَعُونَ فِي بُطُونِهَا أَوْلَادُهَا

It was narrated from ‘Abdullah bin ‘Amr that the Prophet صلی اللہ علیہ وآلہ وسلم said: “Indeed the accidental killing, which seems intentional, with a whip or a stick, (the Diyah) is one hundred camels, of which forty should be (she- camels) with their young in their wombs.” (Sahih)

حَدَّثَنَا مُحَمَّدُ بْنُ کَامِلٍ قَالَ حَدَّثَنَا هُشَيْمٌ عَنْ خَالِدٍ عَنْ الْقَاسِمِ بْنِ رَبِيعَةَ عَنْ عُقْبَةَ بْنِ أَوْسٍ عَنْ رَجُلٍ مِنْ أَصْحَابِ النَّبِيِّ صَلَّی اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ خَطَبَ النَّبِيُّ صَلَّی اللَّهُ عَلَيْهِ وَسَلَّمَ يَوْمَ فَتْحِ مَکَّةَ فَقَالَ أَلَا وَإِنَّ قَتِيلَ الْخَطَإِ شِبْهِ الْعَمْدِ بِالسَّوْطِ وَالْعَصَا وَالْحَجَرِ مِائَةٌ مِنْ الْإِبِلِ فِيهَا أَرْبَعُونَ ثَنِيَّةً إِلَی بَازِلِ عَامِهَا کُلُّهُنَّ خَلِفَةٌ

It was narrated from ‘Uqbah bin Aws, that a man from among the Companions of the Prophet صلی اللہ علیہ وآلہ وسلم said: “The Prophet صلی اللہ علیہ وآلہ وسلم delivered a speech on the Day of the Conquest of Makkah and said: ‘Indeed the accidental killing, which seems intentional, with a whip, a stick, or a rock, (the Diyah) is one hundred camels, of which forty should be pregnant she-camels between the ages of six and nine years old, all in the middle of their pregnancies.” (Sahih)

رَجُلٍ مِنْ أَصْحَابِ النَّبِيِّ ← عُقْبَةَ بْنِ أَوْسٍ، ← الْقَاسِمِ بْنِ رَبِيعَةَ، ← خَالِدٌ، ← هُشَيْمٌ، ← مُحَمَّدُ بْنُ کَامِلٍ

أَخْبَرَنَا مُحَمَّدُ بْنُ بَشَّارٍ عَنْ ابْنِ أَبِي عَدِيٍّ عَنْ خَالِدٍ عَنْ الْقَاسِمِ عَنْ عُقْبَةَ بْنِ أَوْسٍ أَنَّ رَسُولَ اللَّهِ صَلَّی اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ أَلَا إِنَّ قَتِيلَ الْخَطَإِ قَتِيلَ السَّوْطِ وَالْعَصَا فِيهِ مِائَةٌ مِنْ الْإِبِلِ مُغَلَّظَةٌ أَرْبَعُونَ مِنْهَا فِي بُطُونِهَا أَوْلَادُهَا

It was narrated from ‘Uqbah bin ‘Aws, that the Messenger of Allah صلی اللہ علیہ وآلہ وسلم said: “Indeed the accidental killing, the killing with a whip or stick, for it (the Diyah) is one hundred camels — a severe penalty — of which forty should be (she-camels) with their young in their wombs.” (Sahih)

عُقْبَةَ بْنِ أَوْسٍ، ← الْقَاسِمِ، ← خَالِدٌ، ← ابْنُ أَبِي عَدِيٍّ، ← مُحَمَّدُ بْنُ بَشَّارٍ،

أَخْبَرَنَا إِسْمَعِيلُ بْنُ مَسْعُودٍ قَالَ حَدَّثَنَا بِشْرُ بْنُ الْمُفَضَّلِ عَنْ خَالِدٍ الْحَذَّائِ عَنْ الْقَاسِمِ بْنِ رَبِيعَةَ عَنْ يَعْقُوبَ بْنِ أَوْسٍ عَنْ رَجُلٍ مِنْ أَصْحَابِ النَّبِيِّ صَلَّی اللَّهُ عَلَيْهِ وَسَلَّمَ أَنَّ رَسُولَ اللَّهِ صَلَّی اللَّهُ عَلَيْهِ وَسَلَّمَ لَمَّا دَخَلَ مَکَّةَ يَوْمَ الْفَتْحِ قَالَ أَلَا وَإِنَّ کُلَّ قَتِيلِ خَطَإِ الْعَمْدِ أَوْ شِبْهِ الْعَمْدِ قَتِيلِ السَّوْطِ وَالْعَصَا مِنْهَا أَرْبَعُونَ فِي بُطُونِهَا أَوْلَادُهَا

It was narrated from Ya’qub bin Aws, from a man among the Companions of the Prophet صلی اللہ علیہ وآلہ وسلم that when the Messenger of Allah صلی اللہ علیہ وآلہ وسلم entered Makkah on the Day of the Conquest, he said: “Indeed, every accidental killing on purpose, or resembling on purpose — killing with a whip or stick, for it are forty (she-camels) with their young in their wombs.” (Sahih)

أَخْبَرَنَا مُحَمَّدُ بْنُ عَبْدِ اللَّهِ بْنِ بَزِيعٍ قَالَ حَدَّثَنَا يَزِيدُ قَالَ حَدَّثَنَا خَالِدٌ عَنْ الْقَاسِمِ بْنِ رَبِيعَةَ عَنْ يَعْقُوبَ بْنِ أَوْسٍ أَنَّ رَجُلًا مِنْ أَصْحَابِ النَّبِيِّ صَلَّی اللَّهُ عَلَيْهِ وَسَلَّمَ حَدَّثَهُ أَنَّ رَسُولَ اللَّهِ صَلَّی اللَّهُ عَلَيْهِ وَسَلَّمَ لَمَّا قَدِمَ مَکَّةَ عَامَ الْفَتْحِ قَالَ أَلَا وَإِنَّ قَتِيلَ الْخَطَإِ الْعَمْدِ قَتِيلَ السَّوْطِ وَالْعَصَا مِنْهَا أَرْبَعُونَ فِي بُطُونِهَا أَوْلَادُهَا

It was narrated from Ya’qub bin Aws that a man from among the Companions of the Prophet صلی اللہ علیہ وآلہ وسلم told him, that when the Messenger of Allah صلی اللہ علیہ وآلہ وسلم came to Makkah, in the Year of the Conquest, he said: “Indeed, accidental killing on purpose, is killing with a whip or stick, for which forty (she-camels) with their young in their wombs.” (Sahih)

يَعْقُوبَ بْنِ أَوْسٍ ← الْقَاسِمِ بْنِ رَبِيعَةَ، ← خَالِدٌ، ← يَزِيدُ: ← مُحَمَّدُ بْنُ عَبْدِ اللَّهِ بْنِ بَزِيعٍ،

أَخْبَرَنَا مُحَمَّدُ بْنُ عَبْدِ اللَّهِ بْنِ بَزِيعٍ قَالَ أَنْبَأَنَا يَزِيدُ عَنْ خَالِدٍ عَنْ الْقَاسِمِ بْنِ رَبِيعَةَ عَنْ يَعْقُوبَ بْنِ أَوْسٍ أَنَّ رَجُلًا مِنْ أَصْحَابِ النَّبِيِّ صَلَّی اللَّهُ عَلَيْهِ وَسَلَّمَ حَدَّثَهُ أَنَّ النَّبِيَّ صَلَّی اللَّهُ عَلَيْهِ وَسَلَّمَ دَخَلَ مَکَّةَ عَامَ الْفَتْحِ قَالَ أَلَا وَإِنَّ قَتِيلَ الْخَطَإِ الْعَمْدِ قَتِيلَ السَّوْطِ وَالْعَصَا مِنْهَا أَرْبَعُونَ فِي بُطُونِهَا أَوْلَادُهَا

It was narrated from Ya’qub bin Aws that a man from among the Companions of the Prophet صلی اللہ علیہ وآلہ وسلم , narrated to him that the Prophet صلی اللہ علیہ وآلہ وسلم entered Makkah during the Year of the Conquest, and said: “Indeed, accidental killing on purpose, is killing with a whip or stick, for which forty (she-camels) with their young in their wombs.” (Sahih)

يَعْقُوبَ بْنِ أَوْسٍ ← الْقَاسِمِ بْنِ رَبِيعَةَ، ← خَالِدٌ، ← يَزِيدُ: ← مُحَمَّدُ بْنُ عَبْدِ اللَّهِ بْنِ بَزِيعٍ،

أَخْبَرَنَا مُحَمَّدُ بْنُ مَنْصُورٍ قَالَ حَدَّثَنَا سُفْيَانُ قَالَ حَدَّثَنَا ابْنُ جُدْعَانَ سَمِعَهُ مِنْ الْقَاسِمِ بْنِ رَبِيعَةَ عَنْ ابْنِ عُمَرَ قَالَ قَامَ رَسُولُ اللَّهِ صَلَّی اللَّهُ عَلَيْهِ وَسَلَّمَ يَوْمَ فَتْحِ مَکَّةَ عَلَی دَرَجَةِ الْکَعْبَةِ فَحَمِدَ اللَّهَ وَأَثْنَی عَلَيْهِ وَقَالَ الْحَمْدُ لِلَّهِ الَّذِي صَدَقَ وَعْدَهُ وَنَصَرَ عَبْدَهُ وَهَزَمَ الْأَحْزَابَ وَحْدَهُ أَلَا إِنَّ قَتِيلَ الْعَمْدِ الْخَطَإِ بِالسَّوْطِ وَالْعَصَا شِبْهِ الْعَمْدِ فِيهِ مِائَةٌ مِنْ الْإِبِلِ مُغَلَّظَةٌ مِنْهَا أَرْبَعُونَ خَلِفَةً فِي بُطُونِهَا أَوْلَادُهَا

It was narrated that Ibn ‘Umar said: “The Messenger of Allah صلی اللہ علیہ وآلہ وسلم stood up on the Day of the Conquest of Makkah, on the steps of Ka’bah. He praised and glorified Allah, then he said: ‘Praise be to Allah Who has fulfilled His promise, granted victory to His slave and defeated the confederates alone. The one who is killed purposefully by mistake, with a whip or a stick, resembling on purpose, for that (the Diyah) is one hundred camels — a severe penalty — of which forty should be pregnant she-camels with their young in their wombs.” (Da’if)

ابْنِ عُمَرَ ← ابْنُ جُدْعَانَ سَمِعَهُ مِنْ الْقَاسِمِ بْنِ رَبِيعَةَ ← سُفْيَانَ، ← مُحَمَّدُ بْنُ مَنْصُورٍ،

أَخْبَرَنَا مُحَمَّدُ بْنُ الْمُثَنَّی قَالَ حَدَّثَنَا سَهْلُ بْنُ يُوسُفَ قَالَ حَدَّثَنَا حُمَيْدٌ عَنْ الْقَاسِمِ بْنِ رَبِيعَةَ أَنَّ رَسُولَ اللَّهِ صَلَّی اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ الْخَطَأُ شِبْهُ الْعَمْدِ يَعْنِي بِالْعَصَا وَالسَّوْطِ مِائَةٌ مِنْ الْإِبِلِ مِنْهَا أَرْبَعُونَ فِي بُطُونِهَا أَوْلَادُهَا

It was narrated from Al Qasim bin Rabi’ah that the Messenger of Allah صلی اللہ علیہ وآلہ وسلم said: “The accident that resembles on purpose, meaning (killing) with a stick or a whip, (for which the Diyah is) one hundred camels, of which forty should be (pregnant she-camels) with their young in their wombs.” (Sahih)

الْقَاسِمِ بْنِ رَبِيعَةَ، ← حُمَيْدٍ ← سَهْلُ بْنُ يُوسُفَ ← مُحَمَّدُ بْنُ الْمُثَنَّى،

أَخْبَرَنَا أَحْمَدُ بْنُ سُلَيْمَانَ قَالَ حَدَّثَنَا يَزِيدُ بْنُ هَارُونَ قَالَ أَنْبَأَنَا مُحَمَّدُ بْنُ رَاشِدٍ عَنْ سُلَيْمَانَ بْنِ مُوسَی عَنْ عَمْرِو بْنِ شُعَيْبٍ عَنْ أَبِيهِ عَنْ جَدِّهِ أَنَّ رَسُولَ اللَّهِ صَلَّی اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ مَنْ قُتِلَ خَطَأً فَدِيَتُهُ مِائَةٌ مِنْ الْإِبِلِ ثَلَاثُونَ بِنْتَ مَخَاضٍ وَثَلَاثُونَ بِنْتَ لَبُونٍ وَثَلَاثُونَ حِقَّةً وَعَشَرَةُ بَنِي لَبُونٍ ذُکُورٍ قَالَ وَکَانَ رَسُولُ اللَّهِ صَلَّی اللَّهُ عَلَيْهِ وَسَلَّمَ يُقَوِّمُهَا عَلَی أَهْلِ الْقُرَی أَرْبَعَ مِائَةِ دِينَارٍ أَوْ عِدْلَهَا مِنْ الْوَرِقِ وَيُقَوِّمُهَا عَلَی أَهْلِ الْإِبِلِ إِذَا غَلَتْ رَفَعَ فِي قِيمَتِهَا وَإِذَا هَانَتْ نَقَصَ مِنْ قِيمَتِهَا عَلَی نَحْوِ الزَّمَانِ مَا کَانَ فَبَلَغَ قِيمَتُهَا عَلَی عَهْدِ رَسُولِ اللَّهِ صَلَّی اللَّهُ عَلَيْهِ وَسَلَّمَ مَا بَيْنَ الْأَرْبَعِ مِائَةِ دِينَارٍ إِلَی ثَمَانِ مِائَةِ دِينَارٍ أَوْ عِدْلِهَا مِنْ الْوَرِقِ قَالَ وَقَضَی رَسُولُ اللَّهِ صَلَّی اللَّهُ عَلَيْهِ وَسَلَّمَ أَنَّ مَنْ کَانَ عَقْلُهُ فِي الْبَقَرِ عَلَی أَهْلِ الْبَقَرِ مِائَتَيْ بَقَرَةٍ وَمَنْ کَانَ عَقْلُهُ فِي الشَّاةِ أَلْفَيْ شَاةٍ وَقَضَی رَسُولُ اللَّهِ صَلَّی اللَّهُ عَلَيْهِ وَسَلَّمَ أَنَّ الْعَقْلَ مِيرَاثٌ بَيْنَ وَرَثَةِ الْقَتِيلِ عَلَی فَرَائِضِهِمْ فَمَا فَضَلَ فَلِلْعَصَبَةِ وَقَضَی رَسُولُ اللَّهِ صَلَّی اللَّهُ عَلَيْهِ وَسَلَّمَ أَنْ يَعْقِلَ عَلَی الْمَرْأَةِ عَصَبَتُهَا مَنْ کَانُوا وَلَا يَرِثُونَ مِنْهُ شَيْئًا إِلَّا مَا فَضَلَ عَنْ وَرَثَتِهَا وَإِنْ قُتِلَتْ فَعَقْلُهَا بَيْنَ وَرَثَتِهَا وَهُمْ يَقْتُلُونَ قَاتِلَهَا

It was narrated from ‘Amr bin Shuaib, from his father, from his grandfather, that the Messenger of Allah صلی اللہ علیہ وآلہ وسلم said: “Whoever is killed by mistake, his ransom is one hundred camels: Thirty Bint Makhad, thirty Bint Labz n, thirty -Iiqqah and ten Bin Laban.” The Messenger of Allah صلی اللہ علیہ وآلہ وسلم used to fix the value (of the Diyah for accidental killing) among town- dwellers at four hundred Dinars or the equivalent value in silver. When he calculated the price in terms of people with camels (for Bedouin), it would vary from one time to another. When prices rose, the value in Dinars would rise, and when prices fell the value in Dmnars would fall. At the time of the Messenger of Allah صلی اللہ علیہ وآلہ وسلم the value was between four hundred and eight hundred Dinars, or the equivalent value in silver, eight thousand Dirharns. And the Messenger of Allah صلی اللہ علیہ وآلہ وسلم ruled that if a person’s blood money was paid in cattle, among those who kept cattle, the amount was two hundred cows; and if a person’s blood money was paid in sheep, among those who kept sheep, the value was two thousand sheep. The Messenger of Allah صلی اللہ علیہ وآلہ وسلم ruled that the blood money is part of the estate, to be divided among the heirs of the victim according to their allotted shares, and whatever is left over is for the ‘Asabah. And the Messenger of Allah صلی اللہ علیہ وآلہ وسلم i ruled that if a woman commits murder then her ‘Asabah, whoever they may be, must pay the blood money, but they do not inherit anything except that which is left over from her heirs; if a woman is killed then her blood money is to be shared among her heirs, and they may kill her killer.
