حَدَّثَنَا مُسَدَّدٌ حَدَّثَنَا يَحْيَی عَنْ عُبَيْدِ اللَّهِ قَالَ حَدَّثَنِي نَافِعٌ عَنْ عَبْدِ اللَّهِ رَضِيَ اللَّهُ عَنْهُ قَالَ کَانُوا يَبْتَاعُونَ الطَّعَامَ فِي أَعْلَی السُّوقِ فَيَبِيعُونَهُ فِي مَکَانِهِ فَنَهَاهُمْ رَسُولُ اللَّهِ صَلَّی اللَّهُ عَلَيْهِ وَسَلَّمَ أَنْ يَبِيعُوهُ فِي مَکَانِهِ حَتَّی يَنْقُلُوهُ

Narrated `Abdullah: Some people used to buy foodstuff at the head of the market and used to sell it on the spot. Allah's Apostle forbade them to sell it till they brought it to (their) places.

حَدَّثَنَا عَبْدُ اللَّهِ بْنُ يُوسُفَ أَخْبَرَنَا مَالِکٌ عَنْ هِشَامِ بْنِ عُرْوَةَ عَنْ أَبِيهِ عَنْ عَائِشَةَ رَضِيَ اللَّهُ عَنْهَا قَالَتْ جَائَتْنِي بَرِيرَةُ فَقَالَتْ کَاتَبْتُ أَهْلِي عَلَی تِسْعِ أَوَاقٍ فِي کُلِّ عَامٍ وَقِيَّةٌ فَأَعِينِينِي فَقُلْتُ إِنْ أَحَبَّ أَهْلُکِ أَنْ أَعُدَّهَا لَهُمْ وَيَکُونَ وَلَاؤُکِ لِي فَعَلْتُ فَذَهَبَتْ بَرِيرَةُ إِلَی أَهْلِهَا فَقَالَتْ لَهُمْ فَأَبَوْا ذَلِکَ عَلَيْهَا فَجَائَتْ مِنْ عِنْدِهِمْ وَرَسُولُ اللَّهِ صَلَّی اللَّهُ عَلَيْهِ وَسَلَّمَ جَالِسٌ فَقَالَتْ إِنِّي قَدْ عَرَضْتُ ذَلِکَ عَلَيْهِمْ فَأَبَوْا إِلَّا أَنْ يَکُونَ الْوَلَائُ لَهُمْ فَسَمِعَ النَّبِيُّ صَلَّی اللَّهُ عَلَيْهِ وَسَلَّمَ فَأَخْبَرَتْ عَائِشَةُ النَّبِيَّ صَلَّی اللَّهُ عَلَيْهِ وَسَلَّمَ فَقَالَ خُذِيهَا وَاشْتَرِطِي لَهُمْ الْوَلَائَ فَإِنَّمَا الْوَلَائُ لِمَنْ أَعْتَقَ فَفَعَلَتْ عَائِشَةُ ثُمَّ قَامَ رَسُولُ اللَّهِ صَلَّی اللَّهُ عَلَيْهِ وَسَلَّمَ فِي النَّاسِ فَحَمِدَ اللَّهَ وَأَثْنَی عَلَيْهِ ثُمَّ قَالَ أَمَّا بَعْدُ مَا بَالُ رِجَالٍ يَشْتَرِطُونَ شُرُوطًا لَيْسَتْ فِي کِتَابِ اللَّهِ مَا کَانَ مِنْ شَرْطٍ لَيْسَ فِي کِتَابِ اللَّهِ فَهُوَ بَاطِلٌ وَإِنْ کَانَ مِائَةَ شَرْطٍ قَضَائُ اللَّهِ أَحَقُّ وَشَرْطُ اللَّهِ أَوْثَقُ وَإِنَّمَا الْوَلَائُ لِمَنْ أَعْتَقَ

Narrated `Urwa: Aisha said, "Buraira came to me and said, 'I have agreed with my masters to pay them nine Uqiyas (of gold) (in installments) one Uqiya per year; please help me.' I said, 'I am ready to pay the whole amount now provided your masters agree that your Wala will be for me.' So, Buraira went to her masters and told them about that offer but they refused to accept it. She returned, and at that time, Allah's Apostle was sitting (present). Buraira said, 'I told them of the offer but they did not accept it and insisted on having the Wala.'.' The Prophet heard that." `Aisha narrated the whole story to the Prophet . He said to her, "Buy her and stipulate that her Wala' would be yours as the Wala' is for the manumitted." `Aisha did so. Then Allah's Apostle stood up in front of the people, and after glorifying Allah he said, "Amma Badu (i.e. then after)! What about the people who impose conditions which are not in Allah's Book (Laws)? Any condition that is not in Allah's Book (Laws) is invalid even if they were one hundred conditions, for Allah's decisions are the right ones and His conditions are the strong ones (firmer) and the Wala' will be for the manumitted."

حَدَّثَنَا عَبْدُ اللَّهِ بْنُ يُوسُفَ أَخْبَرَنَا مَالِکٌ عَنْ نَافِعٍ عَنْ عَبْدِ اللَّهِ بْنِ عُمَرَ رَضِيَ اللَّهُ عَنْهُمَا أَنَّ عَائِشَةَ أُمَّ الْمُؤْمِنِينَ أَرَادَتْ أَنْ تَشْتَرِيَ جَارِيَةً فَتُعْتِقَهَا فَقَالَ أَهْلُهَا نَبِيعُکِهَا عَلَی أَنَّ وَلَائَهَا لَنَا فَذَکَرَتْ ذَلِکَ لِرَسُولِ اللَّهِ صَلَّی اللَّهُ عَلَيْهِ وَسَلَّمَ فَقَالَ لَا يَمْنَعُکِ ذَلِکَ فَإِنَّمَا الْوَلَائُ لِمَنْ أَعْتَقَ

Narrated `Abdullah bin `Umar: Aisha, (mother of the faithful believers) wanted to buy a slave girl and manumit her, but her masters said that they would sell her only on the condition that her Wala' would be for them. `Aisha told Allah's Apostle of that. He said, "What they stipulate should not hinder you from buying her, as the Wala' is for the manumitted."

حَدَّثَنَا أَبُو الْوَلِيدِ حَدَّثَنَا اللَّيْثُ عَنْ ابْنِ شِهَابٍ عَنْ مَالِکِ بْنِ أَوْسٍ سَمِعَ عُمَرَ رَضِيَ اللَّهُ عَنْهُمَا عَنْ النَّبِيِّ صَلَّی اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ الْبُرُّ بِالْبُرِّ رِبًا إِلَّا هَائَ وَهَائَ وَالشَّعِيرُ بِالشَّعِيرِ رِبًا إِلَّا هَائَ وَهَائَ وَالتَّمْرُ بِالتَّمْرِ رِبًا إِلَّا هَائَ وَهَائَ

Narrated Ibn `Umar: The Prophet said, "The selling of wheat for wheat is Riba (usury) except if it is handed from hand to hand and equal in amount. Similarly the selling of barley for barley, is Riba except if it is from hand to hand and equal in amount, and dates for dates is usury except if it is from hand to hand and equal in amount. حَدَّثَنَا إِسْمَاعِيلُ حَدَّثَنَا مَالِکٌ عَنْ نَافِعٍ عَنْ عَبْدِ اللَّهِ بْنِ عُمَرَ رَضِيَ اللَّهُ عَنْهُمَا أَنَّ رَسُولَ اللَّهِ صَلَّی اللَّهُ عَلَيْهِ وَسَلَّمَ نَهَی عَنْ الْمُزَابَنَةِ وَالْمُزَابَنَةُ بَيْعُ الثَّمَرِ بِالتَّمْرِ کَيْلًا وَبَيْعُ الزَّبِيبِ بِالْکَرْمِ کَيْلًا

Narrated Ibn `Umar: Allah's Apostle forbade Muzabana; and Muzabana is the selling of fresh dates for dried old dates by measure, and the selling of fresh grapes for dried grapes by measure.

حَدَّثَنَا أَبُو النُّعْمَانِ حَدَّثَنَا حَمَّادُ بْنُ زَيْدٍ عَنْ أَيُّوبَ عَنْ نَافِعٍ عَنْ ابْنِ عُمَرَ رَضِيَ اللَّهُ عَنْهُمَا أَنَّ النَّبِيَّ صَلَّی اللَّهُ عَلَيْهِ وَسَلَّمَ نَهَی عَنْ الْمُزَابَنَةِ قَالَ وَالْمُزَابَنَةُ أَنْ يَبِيعَ الثَّمَرَ بِکَيْلٍ إِنْ زَادَ فَلِي وَإِنْ نَقَصَ فَعَلَيَّ قَالَ وَحَدَّثَنِي زَيْدُ بْنُ ثَابِتٍ أَنَّ النَّبِيَّ صَلَّی اللَّهُ عَلَيْهِ وَسَلَّمَ رَخَّصَ فِي الْعَرَايَا بِخَرْصِهَا

Narrated Ibn `Umar: The Prophet forbade Muzabana; and Muzabana is the selling of fresh fruit (without measuring it) for something by measure on the basis that if that thing turns to be more than the fruit, the increase would be for the seller of the fruit, and if it turns to be less, that would be of his lot.

Narrated Ibn `Umar from Zaid bin Thabit that the Prophet allowed the selling of the fruits on the trees after estimation (when they are ripe).

حَدَّثَنَا عَبْدُ اللَّهِ بْنُ يُوسُفَ أَخْبَرَنَا مَالِکٌ عَنْ ابْنِ شِهَابٍ عَنْ مَالِکِ بْنِ أَوْسٍ أَخْبَرَهُ أَنَّهُ الْتَمَسَ صَرْفًا بِمِائَةِ دِينَارٍ فَدَعَانِي طَلْحَةُ بْنُ عُبَيْدِ اللَّهِ فَتَرَاوَضْنَا حَتَّی اصْطَرَفَ مِنِّي فَأَخَذَ الذَّهَبَ يُقَلِّبُهَا فِي يَدِهِ ثُمَّ قَالَ حَتَّی يَأْتِيَ خَازِنِي مِنْ الْغَابَةِ وَعُمَرُ يَسْمَعُ ذَلِکَ فَقَالَ وَاللَّهِ لَا تُفَارِقُهُ حَتَّی تَأْخُذَ مِنْهُ قَالَ رَسُولُ اللَّهِ صَلَّی اللَّهُ عَلَيْهِ وَسَلَّمَ الذَّهَبُ بِالذَّهَبِ رِبًا إِلَّا هَائَ وَهَائَ وَالْبُرُّ بِالْبُرِّ رِبًا إِلَّا هَائَ وَهَائَ وَالشَّعِيرُ بِالشَّعِيرِ رِبًا إِلَّا هَائَ وَهَائَ وَالتَّمْرُ بِالتَّمْرِ رِبًا إِلَّا هَائَ وَهَائَ

Narrated Ibn Shihab: that Malik bin Aus said, "I was in need of change for one-hundred Dinars. Talha bin 'Ubaidullah called me and we discussed the matter, and he agreed to change (my Dinars). He took the gold pieces in his hands and fidgeted with them, and then said, "Wait till my storekeeper comes from the forest." `Umar was listening to that and said, "By Allah! You should not separate from Talha till you get the money from him, for Allah's Apostle said, 'The selling of gold for gold is Riba (usury) except if the exchange is from hand to hand and equal in amount, and similarly, the selling of wheat for wheat is Riba (usury) unless it is from hand to hand and equal in amount, and the selling of barley for barley is usury unless it is from hand to hand and equal in amount, and dates for dates, is usury unless it is from hand to hand and equal in amount"

حَدَّثَنَا صَدَقَةُ بْنُ الْفَضْلِ أَخْبَرَنَا إِسْمَاعِيلُ بْنُ عُلَيَّةَ قَالَ حَدَّثَنِي يَحْيَی بْنُ أَبِي إِسْحَاقَ حَدَّثَنَا عَبْدُ الرَّحْمَنِ بْنُ أَبِي بَکْرَةَ قَالَ قَالَ أَبُو بَکْرَةَ رَضِيَ اللَّهُ عَنْهُ قَالَ رَسُولُ اللَّهِ صَلَّی اللَّهُ عَلَيْهِ وَسَلَّمَ لَا تَبِيعُوا الذَّهَبَ بِالذَّهَبِ إِلَّا سَوَائً بِسَوَائٍ وَالْفِضَّةَ بِالْفِضَّةِ إِلَّا سَوَائً بِسَوَائٍ وَبِيعُوا الذَّهَبَ بِالْفِضَّةِ وَالْفِضَّةَ بِالذَّهَبِ کَيْفَ شِئْتُمْ

Narrated Abu Bakra: Allah's Apostle said, "Don't sell gold for gold unless equal in weight, nor silver for silver unless equal in weight, but you could sell gold for silver or silver for gold as you like."

حَدَّثَنَا عُبَيْدُ اللَّهِ بْنُ سَعْدٍ حَدَّثَنَا عَمِّي حَدَّثَنَا ابْنُ أَخِي الزُّهْرِيِّ عَنْ عَمِّهِ قَالَ حَدَّثَنِي سَالِمُ بْنُ عَبْدِ اللَّهِ عَنْ عَبْدِ اللَّهِ بْنِ عُمَرَ رَضِيَ اللَّهُ عَنْهُمَا أَنَّ أَبَا سَعِيدٍ الْخُدْرِيَّ حَدَّثَهُ مِثْلَ ذَلِکَ حَدِيثًا عَنْ رَسُولِ اللَّهِ صَلَّی اللَّهُ عَلَيْهِ وَسَلَّمَ فَلَقِيَهُ عَبْدُ اللَّهِ بْنُ عُمَرَ فَقَالَ يَا أَبَا سَعِيدٍ مَا هَذَا الَّذِي تُحَدِّثُ عَنْ رَسُولِ اللَّهِ صَلَّی اللَّهُ عَلَيْهِ وَسَلَّمَ فَقَالَ أَبُو سَعِيدٍ فِي الصَّرْفِ سَمِعْتُ رَسُولَ اللَّهِ صَلَّی اللَّهُ عَلَيْهِ وَسَلَّمَ يَقُولُ الذَّهَبُ بِالذَّهَبِ مِثْلًا بِمِثْلٍ وَالْوَرِقُ بِالْوَرِقِ مِثْلًا بِمِثْلٍ

Narrated Abu Sa`id: (Concerning exchange) that he heard Allah's Apostle saying, "Do not sell gold for gold unless equal in weight, and do not sell silver unless equal in weight."

Narrated Abu Sa`id Al-Khudri: Allah's Apostle said, "Do not sell gold for gold unless equivalent in weight, and do not sell less amount for greater amount or vice versa; and do not sell silver for silver unless equivalent in weight, and do not sell less amount for greater amount or vice versa and do not sell gold or silver that is not present at the moment of exchange for gold or silver that is present.

حَدَّثَنَا عَلِيُّ بْنُ عَبْدِ اللَّهِ حَدَّثَنَا الضَّحَّاکُ بْنُ مَخْلَدٍ حَدَّثَنَا ابْنُ جُرَيْجٍ قَالَ أَخْبَرَنِي عَمْرُو بْنُ دِينَارٍ أَنَّ أَبَا صَالِحٍ الزَّيَّاتَ أَخْبَرَهُ أَنَّهُ سَمِعَ أَبَا سَعِيدٍ الْخُدْرِيَّ رَضِيَ اللَّهُ عَنْهُ يَقُولُ الدِّينَارُ بِالدِّينَارِ وَالدِّرْهَمُ بِالدِّرْهَمِ فَقُلْتُ لَهُ فَإِنَّ ابْنَ عَبَّاسٍ لَا يَقُولُهُ فَقَالَ أَبُو سَعِيدٍ سَأَلْتُهُ فَقُلْتُ سَمِعْتَهُ مِنْ النَّبِيِّ صَلَّی اللَّهُ عَلَيْهِ وَسَلَّمَ أَوْ وَجَدْتَهُ فِي کِتَابِ اللَّهِ قَالَ کُلَّ ذَلِکَ لَا أَقُولُ وَأَنْتُمْ أَعْلَمُ بِرَسُولِ اللَّهِ صَلَّی اللَّهُ عَلَيْهِ وَسَلَّمَ مِنِّي وَلَکِنْ أَخْبَرَنِي أُسَامَةُ أَنَّ النَّبِيَّ صَلَّی اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ لَا رِبًا إِلَّا فِي النَّسِيئَةِ

Narrated Abu Salih Az-Zaiyat: I heard Abu Sa`id Al-Khudri saying, "The selling of a Dinar for a Dinar, and a Dirham for a Dirham (is permissible)." I said to him, "Ibn `Abbas does not say the same." Abu Sa`id replied, "I asked Ibn `Abbas whether he had heard it from the Prophet s or seen it in the Holy Book. Ibn `Abbas replied, "I do not claim that, and you know Allah's Apostle better than I, but Usama informed me that the Prophet had said, 'There is no Riba (in money exchange) except when it is not done from hand to hand (i.e. when there is delay in payment).' "
